| Since the 20 th century,GM foods have been widely promoted,and their emergence has not only solved the food shortage problem that has been plagued by human beings for a long time,but also brought huge benefits to the major genetically modified food enterprises and GM crop growers.However,with the development of genetically modified foods,their safety issues have increasingly attracted the attention of the public.In view of the safety of genetically modified foods,it has been in a state of doubt until now.Therefore,for the purpose of protecting consumers' right to know and the safety supervision of genetically modified foods,the genetically modified food labeling system came into being.With the change in attitudes toward GM food labeling in the United States in July 2016,the trend of implementing mandatory labeling regulations for GM foods in the world is becoming more and more obvious.Our country's mandatory labeling system for genetically modified foods was initially constructed in 2002,but the lack of effective updates has led to the current legislation on the labeling of genetically modified foods in China,which is far from the actual situation of the development of genetically modified foods in China.Many problems gradually It is exposed and needs to be improved.This article takes the transformation of the US GM labeling system in July 2016 and the release of the US National Bioengineering Food Information Disclosure Standard in December 2018.With reference to the management experience of the EU,Japan and other countries,according to the actual situation of our country,A certain analysis of how to improve China's mandatory labeling system for genetically modified foods.This article mainly discusses the following four aspects:The first part: from the meaning of the mandatory label of genetically modified food,the connotation of mandatory identification,the type and characteristics of mandatory identification,the difference between mandatory identification and voluntary identification and the legal basis of the mandatory identification system of genetically modified foods were analyzed in detail.The second part: combing the legislative status quo of China's GM food labeling problem,combined with China's national conditions,analyzed the problems existing in China's current mandatory labeling system,mainly including: 1.Legislation is generally scattered and lack of update;2.The scope of the label is not sound enough;The identification method is not perfect;4.The identification supervision mechanism is not complete enoughThe third part: analysis of three different types of genetically modified food compulsory labeling system outside the domain,to explore the management basis,main legal provisions of the representative national GM food compulsory labeling system,compare the differences and advantages between the three different systems,combined with China's specific The national conditions have drawn implications for the mandatory labeling system for genetically modified foods in our country.The fourth part: put forward corresponding suggestions for the problems existing in the current legal system for the identification of genetically modified foods in China,mainly including: 1.Formulating special administrative regulations for genetically modified foods;2.Improving the scope of identification,including:(1)sound identification The scope of the subject;(2)The scope of the target of the improvement: clearly identify the scope of the object and update the catalogue of the logo,increase the provisions on the exemption of the logo,and relax the threshold of the logo;3.Improve the identification method,including: increase the provisions on the "negative logo",increase Traceable identification,creation of two-dimensional code and other electronic identification methods;4.Improve the label supervision mechanism,including: clear the regulatory body and its authority,and strengthen information disclosure and popular science propaganda. |
