With the rapid development of China's economy and the gradual increase of population,the employment problem has been paid more and more attention to every year when the number of graduates reaches a new high.Employment is a problem of people's livelihood,solving employment problem is an important prerequisite to maintain social stability.In order to protect the employment rights of female workers and promote substantive equality,our country issued the special regulations on the labor protection of female workers.With the transition of China's economic system,the special protection of female workers is becoming more and more malpractice.In particular,"the first case of gender discrimination in employment opportunities in China" makes us aware of the employment inequality caused by the protection of women,and shows more clearly the lack of legislation on such phenomena in the law.Loss leads to more gender discrimination in employment.There are many problems in the special protection system,such as the regulation of principle,the application of machinery and the incomplete system,which lead to more social problems.The more difficult situation that women face in the employment of overprotection is a social problem that cannot be ignored in the present time.In order to realize the equal rights of women in the employment,the promotion of equality from the system is an early policy of our country.From the point of view of time and history,there are some places to be taken,and play a positive role in promoting the equality of men and women's employment,and it is not to be neglected that the basic national policy for promoting the equality of women and men in our country has also played a very important role.However,with the development of science and technology,the rise of artificial intelligence and theprogress of social consciousness,the current employment protection policy has The problem of equal employment equality between men and women can not be completely solved.On the contrary,because the system can not fully meet the development of the market economy,the difficulty of women entering the workplace is becoming higher and higher,and the threshold of women entering the workplace is becoming more and more high,and women face more severe employment pressure.This paper mainly discusses and analyzes the difficulties and resistance of the female employment caused by the system of the "Special protection" in the female employment.It was found that the system of the protection of women had some problems in the employment of women,and the current women were treated differently in the process of job search because of the differences in the physiological factors,which Do not treat and often have institutional support,and for such a distinction,the existing legal provisions can not clearly determine whether such a distinction is reasonable or unreasonable.Therefore,how to improve the special protection system to avoid the new gender discrimination in employment has become an important problem.In view of this,this paper is based on the current legal norms and relevant theories of law,from the perspective of judicial application in specific cases,and in the form of combining theory with examples.The regulations of maternity protection and professional taboos in the special legal protection of female workers are sorted out at the legal level and type.And introducing the case of special protection employers refusing women shows the limitations of special protection in judicial practice.This paper analyzes the influence of birth protection and professional taboos on women's rights in the special protection system,and puts forward specific ideas and countermeasures to solve the problems,in the hope that it can be used for women's employment equality law.The practical problems in the protection of laws provide countermeasures,provide a way of thinking for the solution of theoretical problems,and help to improve the legal protection system to promote gender equality in employment.
