The debate over network neutrality that all legal data on the Internet should be treated equally is widely discussed by governments,scholars and public worldwide especially in the US.The answer to what net neutrality is and what it should be varies.But it's clear that the concept has been an essential part of our life though it's rarely discussed in ChinaThis paper first analyzed the origin of net neutrality,by discussing the definition and substantive part of the concept revealed that the core issue of the debate is how to balance the interest between the broadband service provider and its counterpart.The legislation practice and several milestone cases of U.S.in the last decade indicate that the US regulation approach changes over time to set a balance between openness and control in a networked society.Finally,the paper discussed the possibility of government regulation in China based on our own present industry reality and legal system.Then developed a theoretical perspective on restricting false network power abuse behavior of BSP to shape a harmonious network society.
