Study On Rule Of Law Of Countermeasure In Urban Traffic Congestion

Traffic is the lifeblood of the city.With the rapid development of China's economy,the holding amount of cars(especially private cars)presents a sharply increasing trend.The contradiction of traffic supply and demand becomes increasingly prominent.Resolving urban traffic congestion has become a major problem in urban development.If we do not study timely effective measures to control traffic congestion as soon as possible,the urbantraffic congestion in our country will be widespread and aggravated.Moreover,it will have negative effect on thetraffic efficiency and urban residents' quality of life and restrict the sustainable,healthy and rapid development of economy and society.There are many paths to control of urban traffic congestion.But this paper argues that the rule of law is the most reliable and effective way in the context of comprehensive rule of law.In view of the current situation of urban traffic congestion in China,this paper aims to resolve how to control the traffic congestion in China,discusses the current situation and reasons of urban traffic congestion in China and the shortcomings of legal ruling in governing the traffic congestionwhich includesthe controversy over the legal measures,the supply of regulation and rules in traffic demand,the drawbacks of decentralized administrative enforcement system,the ability of enforcement staff,the attenuation of traffic law enforcement supervision system,and the weak awareness of citizens to observe law and regulation.This paper learns from Singapore,the United States,South Korea and other foreign government in urban traffic congestion measures.Combined with China'ssituation,it puts forward to legal suggestion tosolve the urban traffic congestion,which includes the establishment of specific traffic fund committee from a long-term point of view,the special measurement of urban traffic congestion,the enactment of public transport regulation,the proposal of environmentally friendly trip mode,the perfection of non-motor vehicle transport and relevant labour law and regulation,lead employment unit to arrange working hours based on all the issues in order to avoid rush hour.This paper analyzes the possibility of implementation of charging system under traffic congestion in major cities from micro perspective,improves and promotes thevehicle licensing system.In the aspect of urban traffic law enforcement,it puts forward establishing a unified enforcement managementsystem in road transport,improvingcapacity of traffic law enforcement team,enhancing people's awareness of observing traffic rules by promoting the propaganda and education.Although it is difficult to solve this problem and there is a long way to go,people should still keep the confidence in dealing with this tough issue.
