Child abuse in children's services undoubtedly become the most popular topic of child safety in recent years.It refers to abuse behaviors happened in children's services that provide children's well-being such as education and upbringing.Child abuse including physical injury,psychological abuse,sexual abuse and neglect,are committed by workers working with children,which violate seriously children's well-being.The direct causes of child abuse are the unscientific setting of professional access qualification standards for employees and the lack of strict control in operation,resulting in a large number of persons who should not engage in child-related occupations or have potential risks to children enter the child services,which provides the facilitating conditions for them.Therefore,the most direct and effective resolution to child abuse in child services is to achieve effective screening of potential child abusers,and exclude them from the child's living environment in order to eliminate opportunities and conditions for the commission of crime.There is a lack of a systematic and complete pre-employment screening system for employees of children's services in China.The present professional admission norms of children's services in China are mainly focused on four aspects: professional qualifications,health conditions,law-abiding situation and moral qualities.Guidelines have been provided for access to relevant occupations,but there are still problems such as fragmentation of forms,lack of systematicness,disharmony of contents,disconnect from the legal system of dualistic illegal sanctions,lack of procedural provisions,and so on.The unscientific setting of audit standard and the non-standard operation of practice lead to the failure of examination.It is legitimate to construct the system of pre-employment screening of employees of children's services.On the one hand,the law of children's physical and mental development requires strictly the safety and purity of the environment in which they live,and the closed nature of the environment also requires effective isolation of external risks in order to ensure the safety of children;On the other hand,the system of pre-employment screening of employees meets the value orientation of the special protection of children of the current legal system in our country,conforms to the general expectations of the society and the public.With the favorable conditions provided by the development of network technology and data sharing,its feasibility is indisputable.Moreover,foreign countries and regions have accumulated a great deal of mature experience in long-term legislation and practice,and have established more reasonable standards and relatively perfect provisions in many aspects,such as the delineation of scope of the object,the composition of the examination contents and the review procedures,which can be taken as the reference.In order to establish the pre-employment screening system for the employees of children's services in accordance with the reality of our country,it is necessary to make it clear from the point of legislation.In order to guarantee the validity and rigidity of the system,this paper puts forward three kinds of legislative mode schemes.In terms of content,it puts forward to establish the scope of examination object with the standard of contact,which improves the conditions that the current scope of the object is not clear and the method of division is simple.On the basis of the existing admission norms,this paper puts forward a hierarchical system of criminal record based on the criterion of the correlation with harm,and design a psychological measurement scheme,which is mainly based on individual personality and occupational adaptability,supplemented by social investigation in order to ensure the continuity and rationality of the system.In terms of procedure,we should make up for the defects of the existing procedure,and make clear provisions from the aspects of the initiation of preemployment screening,the transmission and confidentiality of information,the operation of procedures and the remedy of rights,with the help of the convenience brought by the development of network development.
