Study On Supervision On Urban Management Comprehensive Law Enforcement

The Fourth Plenary Session of the 18 th CPC Central Committee deliberated and adopted the "Decision on Several Major Issues Concerning the Comprehensive Promotion of Ruling the Country by Law",and the Central Committee of the Communist Party of China issued the "Guidelines on Building A Law-based Government(2015-2020)".They unanimously emphasized the need to improve the restriction and supervision of the operation of administrative power,clarifying that strengthening the supervision of administrative law enforcement is the basic work and important task of comprehensively promoting the rule of law and building a socialist country ruled by law.In 2017,the “three systems” that adhered to the problem-oriented approach were extensively piloted in the field of administrative law enforcement,striving to minimize abuse of power.As an activity with the largest number,the widest scope and the most direct impact on people's interests in the field of administrative law enforcement,urban management comprehensive law enforcement involves almost all aspects of social life and production.Once the administrative power of urban management comprehensive law enforcement is out of balance,it will seriously affect people's trust and evaluation on the government.Strengthening the supervision of urban management comprehensive law enforcement,promoting the standardized operation of urban management comprehensive law enforcement rights,and safeguarding people's legitimate interests have become a subject that needs to be studied urgently.Optimizing the supervision on urban management comprehensive law enforcement is a systematic project,which requires both institutional thinking and mechanical design.Under the guidance of the principle of procedural justice,this paper analyzed the status quo of supervision on urban management comprehensive law enforcement,and summarized the problems existing in the content of supervision,supervision stage,supervision consequences and utilization of supervision results,including neglecting the supervision of law enforcement procedures,lack of control over the law enforcement process,insufficient punishment,and neglect of the use of supervision results,analyzed the causes of these problems from the perspective of difficulties of supervision on urban management comprehensive law enforcement,supervision system,supervision mechanism,etc.,discussed the feasibility of optimizing urban management comprehensive law enforcement supervision from the perspective of procedural justice on the basis of learning from foreign experience,and finally put forward some countermeasures and suggestions from the perspectives of system construction before supervision,improvement of mechanism in supervision,and application of results after supervision for strengthening the regulation of the operation of urban management comprehensive law enforcement and improving the administrative level of urban management comprehensive law enforcement.
