Research On Supervisory Power

In March 2019,the Second Session of the 13 th National People's Congress was successfully held,indicating that the reform of the national supervision system was pushed forward at a new starting point and the reform of the national supervision system continued to deepen.With the revision of the Constitution of the Communist Party of China(hereinafter referred to as the "Party Constitution"),the Constitution of the People's Republic of China(hereinafter referred to as the "Constitution")and the "Publication Law of the People's Republic of China"(hereinafter referred to as the "Supervisory Law")The National Monitoring Committee was formally established and the national monitoring system framework has been formed.In the practice operation,the power of supervision gradually reveals the problems that need to be deepened,hinders the improvement of the supervision system,and hinders the legitimate,independent and efficient operation of the supervision power.To deepen the study of the operation of supervision power,we must recognize the new mission and new tasks faced by the deepening of the operation of the supervision power at the new starting point,which will help the operation of the supervision power to continue to advance and facilitate the reform of the supervision system.The first part of this paper combs the general theory of supervision power,including the concept and characteristics,nature and content of supervision power,and the elements of supervision power,such as the subject,object and principle of supervision,and analyzes the power of supervision,investigation and disposal in the content of supervision.I have an understanding of the supervisory power and the supervisory committee in the basic knowledge and general theory.The second part studies the relationship between the power of supervision and the power of other countries,including the relationship between the power of supervision and the disciplinary committee to supervise discipline,the supervision of the people's congress,the judicial power of the judiciary,the executive power of the government,and the law enforcement power of law enforcement.Through in-depth analysis,it expounds the power relationship between the supervisory power and the various agencies,and rationalizes the relationship between powers,laying the foundation for the next study.The third part expounds the obstacles encountered in the operation of supervision power and the series of issues that need to be deepened and explored under the background of deepening the supervision system reform.For example,the legal basis for the operation of monitoring power is insufficient;the operating mechanism is not perfect;the operational guarantee mechanism is imperfect;and the supervision and control of the operation of monitoring power is weak.Analyze the problems encountered in the practice of monitoring power,find out the factors that restrict the independent,efficient and legal operation of supervision,and provide ideas for the realization of the right to monitor according to law.The fourth part is to study and analyze the problems encountered in the operation of monitoring power,and put forward suggestions for realizing the right to monitor according to law.Such as: strengthening the supervision of the construction of the legal system;improving the procedural mechanism for the operation of the supervision power;improving the guarantee mechanism for the operation of the inspection power;strengthening the supervision and control of the operation of the inspection power,and providing reference for the deepening of the supervision power.
