Nozick,as a representative of neo-liberalism,adheres to the principle of freedom supremacy,defends individual rights,and puts forward his right-centered justice thought.In his book Anarchy,the State and Utopia,he demonstrated the theory of holding justice in detail with his unique writing style,which provided a new perspective for inquiring into the issue of justice,triggered controversy about the theory of justice in the academic circles,and provided a theoretical basis for the construction of a reasonable theory of justice.Justice is a historical topic.Different scholars have different understandings of justice in different periods.Nozick's theory of holding justice is put forward against the background of the malpractice of welfare society,and equal distribution is questioned.He critically inherited the ideas of Locke?Kantand Smith,and questioned the modern liberal concept of equality and justice.The theory of holding justice is based on the theory of rights,and puts forward three principles of holding justice from the theory of individual rights.If a person holds justice in accordance with the principles of obtaining justice,transferring justice and correcting justice,he holds right to it,which is just.As soon as the theory of holding justice was put forward,it aroused controversy in academic circles.Rawls?Cohen and McIntyre criticized Nozick's theory of justice from the perspectives of freedom supremacy and safeguarding socialist legitimacy and virtue,respectively,and revealed its defects.Nozick admitted that his theory lacked humanity,so he weakened the position of rights and obligations in his later thoughts,and balanced individual rights and state power.This article objectively analyzes its rationalization and limitations,absorbs the essence of theory,with a view to building a justice system with Chinese characteristics.This paper uses historical analysis to explore the social and historical background and ideological origin of holding justice and grasp its theoretical development context;uses comparative analysis to explore scholars' criticism of Nozick's holding justice theory,andcomprehensively analyses its rationality and limitations;Qualitative analysis of Nozick's later thoughts and relevant materials.
