With the rapid development of urbanization in China,China's urban population is more and more.The continuous increase of population leads to a sharp increase in municipal solid waste.It is found that the current disposal speed of municipal solid waste in China is much lower than its growth rate.The great contrast between inefficient disposal capacity and high speed-growth municipal solid waste has become the main problem facing urban ecological environment.At present,the allocation of rights and obligations among the subjects in the legislation of municipal solid waste disposal in China is in an unbalanced state,which is the main reason for the low disposal capacity.Therefore,reversing the current imbalance of the allocation of rights and obligations in the disposal of municipal solid waste has become the fundamental method to solve the above problem.This paper studies from the following aspects.First of all,from the basic status quo of municipal solid waste disposal in China.Analysis of the problems existing in the disposal of municipal solid waste.Secondly,it extracts the legal problems that the rights and obligations among the subjects are in an unbalanced state in the legislation of municipal solid waste disposal,which is the main reason for the unfavorable disposal of municipal solid waste at present.Thirdly,it introduces the practical experience of the extraterritorial developed countries in the disposal of municipal solid waste and combs its legal system.To provide reference for the legislative reform of domestic waste disposal in China.Finally,based on the existing legal framework of municipal solid waste disposal in China.Propose that,from the two dimensions of law and non-law in order to realize the balanced allocation of the rights and obligations of each subject in the disposal of municipal solid waste in order to truly achieve the efficient disposal of municipal solid waste.
