At present,China's industrialization and urbanization speeds are gradually accelerating.In order to improve living conditions and improve living standards,the surplus labor force in China's vast rural areas has flown into the cities.The “working tide” has played a positive role in promoting the development of urbanization,but it has also had a certain negative impact.Due to the existing household registration system in China and the poor family conditions of migrant workers,the children of most migrant workers cannot go to the city to study together with them.They can only stay in the home where the parents are guarded by one of their parents or their ancestors.It is not conducive to the healthy growth of rural“left-behind children”,and it is not conducive to the protection of the rights of “left-behind children” in rural areas.The most obvious one is the guarantee of rural “left-behind children's right to education”.For example,“left-behind children” in rural areas face the problem of unequal access to education and unequal access to education.According to the relevant content released by the National Bureau of Statistics,the number of “left-behind children” in rural areas in China has reached more than 70 million in 2017,and most of them face the problem that the right to education cannot be guaranteed.Solving the problem of education of“left-behind children” in rural areas is not only related to the healthy development of the national education,but also to the general improvement of the quality of the people.The current law has played a certain positive role in guaranteeing the right to education of“left-behind children” in rural areas,but there are still certain defects in legislation,administrative law enforcement and judicial relief.From the perspective of legal protection,this paper analyzes the existing legal system to guarantee the lack of the right to education of left-behind children in rural areas,and uses comparative research methods to examine the legislative,administrative law enforcement and legal relief of the United States,Japan and other educational powers.The legal provisions of the other aspects,combined with the status quo of the legal protection of the "left-behind children" in China's rural areas,put forwardsome perfect suggestions,which caused the community to pay attention to and protect the "left-behind children".The writing of this paper is mainly carried out from the following three aspects: The first part is mainly an overview of the basic issues of “left-behind children” and“right to education” in rural areas.The second part is mainly about the status existing problems of the current "left-behind children" in China's rural areas.The third part is mainly to compare the legal protection of the right to education of children in the country outside the country,so as to get the enlightenment of the legal protection of the rural left-behind children in the legislative,administrative law enforcement and judicial relief,so that the existing The relevant legal system is improved.Only by strengthening the legal guarantee for the right to education of the "left-behind children" in rural areas can we truly solve the "three rural issues" and provide an endless source of motivation for rural progress and for the country's progress.
