The Difficulties And Countermeasures Of Community Correction In Grassroots Judicial Offices

With the continuous advancement and development of human society,the understanding of punishment has been deepening.From the ancient law of severe punishment to the current civilized law enforcement,history has gone through thousands of years.With the progress of the modern industrial revolution,European and American countries have initiated criminal reforms and tried to carry out pilot work of non-custodial punishment.With the good results of the non-custodial punishment pilot work,non-custodial punishments have gradually been recognized and applied on a large scale in countries around the world.Now,non-custodial penalties in many countries and regions have become the way to execute penalties in parallel with imprisonment penalties.The non-custodial penalty system in the modern sense of China,that-is,the community correction system has been piloted in some areas since 2003 and has been fully implemented throughout the country.It has been 15 years since the community correction work has been completed in these ten years.The society widely agrees that it is in line with the development trend of penalties of lenient and strict,which is conducive to alleviating the cost of justice.It is conducive to the smooth return of criminals with serious crimes and social harm,and is more conducive to the construction of safe China.Community correction is a hot topic in the field of jurisprudence in China,However,there are few studies on the predicament faced by the grassroots judiciary responsible for the daily work of community correction,and more studies are carried out from the aspects of community correction legislation and the nature of community correction.This paper is divided into five parts.The first part is an overview of community correction.From the perspective of the status quo,nature and core concepts of community correction,the key concepts of community correction are clarified,which lays a foundation for later writing.The second part is the development status and characteristics of community correction.This part is divided into three aspects:the evolution process of community correction,the status of community correction work in Tainan Judicial Institute of Taizhou City,and the characteristics of community correction work at the grassroots judicial center.The third part is the predicament of the community correction work at the grassroots judicial center.This part analyzes the current dilemma from three aspects and the current predicament of the community correction work of the Tainan Judicial Institute in Taizhou City.The community correction system is not perfect at the grassroots judicial center,the community correction system at the grassroots judicial center is not smooth,and the grassroots justice community corrects the community.The actual implementation of the work is weak.The fourth part is the analysis of the reasons for the predicament of community correction work in grassroots judicial offices.From three different perspectives,the reasons for the dilemma of the community correction work at the grassroots judicial center were analyzed,and finally the reasons for the dilemma of the community correction work at the Dainan Justice Institute in Taizhou City were contacted.The fifth part proposes countermeasures for the predicament of community correction work in grassroots judicial offices.The author believes that we should start from the following aspects:First,improve the community correction system at the grassroots judicial center.Second,rationalize the community correction system at the grassroots judicial center.Third,improve the actual implementation of community corrections at the grassroots judicial center.
