The Legal Protection Of Consumers' Right To Know In Commercial Housing Transactions In China

With the rapid development of the commercial housing market,housing prices all the way up,developers use its dominant position,frequent violations of the legitimate rights and interests of commercial housing consumers,especially the problem is that the infringement of commercial housing consumers right to know disputes are more common.In view of the outstanding problem of infringing on the legitimate rights and interests of consumers in commercial housing transactions,China has formulated and promulgated a number of laws,administrative regulations and local regulations.But these laws and regulations do not fundamentally solve the current commercial housing market in China's false advertising,deliberate concealment of housing quality,housing area fraud and other ways to infringe the consumer's right to know phenomenon.Consumer's right to know,as a basic right of consumers,is the premise of determining whether consumers buy houses in commercial housing transactions.By defining the concept of commercial housing consumers and their right to know,analyzing the necessity of consumers' right to know protection in commercial housing transactions,and on the basis of combing the classic cases of infringing on the right to know of commercial housing consumers,this paper summarizes the existing legislative dilemma,the supervision is not in place,the consumer's rights protection mechanism and the relief channel is relatively single.Combined with the relevant experience of punitive compensation,information disclosure,group litigation and third-party deposit depository system in the protection of the right to know of commercial housing consumers in the United States,it is proposed to improve the legislation of the consumer's right to know protection,strengthen the supervision of commercial housing sales,establish a diversified consumer's right to know protection and relief system,standardize the commercial housing market,and protect the right of commercial housing consumers to know.
