Although e-commerce has developed in China for 20 years,the development of e-commerce has not only changed the consumer's off-line shopping habits,but also changed the composition of China's economy.This impact has put forward higher requirements for more industries.Enterprises need to strengthen themselves so that they can keep up with the tide of the times.At the same time,with the development of e-commerce,consumers,operators,regulators and other roles have also changed compared with traditional transactions.Because the characteristics of e-commerce break the restrictions of region and space,if in a good market environment,while facilitating consumers,the operators of e-commerce also have a broader channel of economic sources,thus promoting the sound development of the economy.However,if the operators are not trustworthy and infringe on the rights and interests of consumers,and because of the characteristics of e-commerce,consumers will find it difficult to claim,which will make consumers fear.In the long run,the virtual economy may fall into the altar and have a strong Matthew effect.So,while e-commerce brings a new era,consumers'rights and interests also have new demands in the new era.It is not enough to rely on the consumer protection system under the traditional civil and commercial law.Although China promulgated the Electronic Commerce Law of the People's Republic of China in 2018,the protection of consumers is still insufficient.China's electronic commerce has reached the forefront of the world in business,and should also lead the direction of world legislation.The main body of this paper is divided into four parts:The first part defines the concepts of e-commerce,operators and consumers in theory.Then it discusses how the current development of e-commerce challenges consumers'rights and interests,and discusses the particularity of the protection of consumers' rights and interests in e-commerce.The second part elaborates the legislative status of consumer rights and interests protection in e-commerce in China.In the 20 years of rapid development of e-commerce,China has adjusted the Law of the People's Republic of China on the Protection of Consumer Rights and Interests in order to deal with the problems,and promulgated the Law of the People's Republic of China on E-commerce in 2018.However,in the face of the development of e-commerce,it is still unable to maintain consumer rights and interests intact,and there are still many problems to be improved.The third part refers to foreign legislation on the protection of consumers'rights and interests in e-commerce,aiming at the problem that consumers' right to know,right to fair dealing and right to claim are vulnerable to infringement in e-commerce,and refers to the legislation of the United States,Japan,South Korea and other countries to provide reference for improving the protection of consumers'rights and interests in e-commerce in China.The fourth part is to improve the protection of consumers'rights and interests in e-commerce in China.From the perspective of the particularity of the protection of consumers'rights and interests in e-commerce,this paper puts forward some suggestions on the protection of consumers' right to know,right to fair deal and right to claim.
