Research On Compliance Of Government Fund Arrangement In Regional Development PPP Project

During the national two sessions in March this year,the ministry of finance issued the opinions on the implementation of promoting the standardized development of government-private capital cooperation(caijin[2019]no.10)(hereinafter referred to as "document no.10")to the public,demanding the standardized and promoted implementation of PPP,strengthening the standardized management of projects,and clarifying the positive and negative list of compliance PPP.The document requires that standard PPP projects should be included into the project database of the national PPP comprehensive information platform(i.e.put into storage)as required.Meanwhile,the document also stipulates that new contracted projects should not be allocated with PPP project operation subsidy expenditure from the budget of government-managed funds and the budget of state-owned capital operation,or else they will not be put into storage.To many largely depend on the government funds such as government spending future development of the PPP projects in the source of a huge impact,with previous related policy allows the PPP government-managed funds can be used as a whole support the development of tone is very different,the governmental funds directly with "isolation" sources of future government spending,to a large extent changed the development of the PPP projects in the future the development direction of business model,no.10 and so on industry can blockbuster "new rules".Case in this article,through the practical work,under the background of current policy faces a series of operational problems,try to talk from the perspective of law,policy and market development in the new rules of the PPP projects,the influence of governmental fund budget policy basis and spending path,mechanism analysis of developmental PPP using government funds and how to explore the compliance budget etc one by one.The paper is divided into five parts:The first part is the introduction,which introduces the background,research purpose and practical significance of the article.The second part mainly introduces the basic contents of developing PPP in the area,including definition,classification,development mode and development trend.It also analyzes the current laws,regulations and policies on PPP,including laws and regulations,government rules and regulations,normative documents of departments,etc.It mainly introduces the impact of document no.10 on the budget arrangement of government-managed funds for PPP projects.The third part focuses on the realistic basis and mechanism analysis of PPP project fiscal expenditure arranged by government-managed fund budget.Firstly,this paper discusses the practical basis of using government-managed fund budget to arrange fiscal expenditure for PPP projects that have been put into storage.We will explore the legal basis for the responsibility of government expenditure on PPP projects in the budgets of government-managed funds,from the perspectives of the budget law,the provisions on the management of government-managed funds,the demonstration of the fiscal affordability of PPP projects and the relevant Suggestions of the NPC.Then,it analyzes the statistics of government-managed fund budget used in national demonstration projects and regional development projects,and shows that there are evidences and examples to be followed for government-managed fund expenditure in PPP projects.This paper analyzes the operation mechanism of using government-managed funds for district development PPP projects.Based on the necessity of using government-managed funds for developing PPP projects in the region,this paper analyzes the return mechanism design of development PPP and the self-balance of development PPP projects through the revenue of government-managed funds within the region.From compliance to participate in social capital for development of PPP after land consolidation,can obtain from the area of government-managed funds reasonable profits,analyzes how social capital in accordance with the law of compliance in the PPP project of land consolidation services and provide relevant land consolidation investment,through the overall development of social capital promote regional value after the implementation of new financial income,and then through fiscal "income and expenses two line management arrangements"governmental social capital investment funds in the budget.The fourth part puts forward several Suggestions on budget arrangement for compliance use of government-managed funds for PPP projects.First,we will take overall consideration and implement policies in different categories and clear application nodes of new regulations.For projects that have been signed but not put into storage,we should stick to the spirit of contract and act in accordance with the contract,and actively improve the budget arrangement For the new projects that have been purchased and not contracted or not purchased,execute according to the requirements of the new policy and explore new modes;Second,we should launch a renegotiation mechanism to reasonably allocate risks and find a new balance between risk sharing and benefit protection between the government and social capital.Three is a PPP regulations,standardize governmental funds use as soon as possible,according to the principle of "substance over form",to realize self balancing through self hematopoietic development of PPP project,on the premise of government debt risk control,suggested that allows moderate use government-managed funds as a whole in the PPP project spending,in order to promote local economic development.
