Study On The Problem Of Duty Performance To Protect Rights And Improvement Measures Of Non-public Enterprise Trade Union In Gansu Province

The Chinese trade unions designated by the Chinese Communist Party plays a role in coordinating the contradictions between enterprises and laborers.It has made important contributions in resolving the contradiction between labor and capital,protecting the rights and interests of laborers,and building a harmonious labor-management relationship.The trade unions are created and existed to safeguard their rights,and it is the basic duty of Chinese trade union to protect the legal rights and interests of workers from infringement.If the legal rights and interests of employees can not be well maintained,Unions would lose their footing.However,with the continuous development of our economy progress,some problems have arisen in the non-public enterprise trade union organizations in the process of safeguarding the legitimate rights of workers.For example,the autonomy of trade unions is not strong,the representative of trade union chairmen is not high,and the mechanism of trade union rights protection is a mere formality.These problems make the trade union unable to be a good spokesman for the interests of workers,unable to represent the demands of workers,the phenomenon of damage to the rights and interests of workers in non-public enterprises is widespread.As an economically underdeveloped region,Gansu province has not paid enough attention to the protection of labor union rights of non-public enterprises due to the rapid update speed of non-public enterprises and the lack of relevant research,resulting in many problems in the protection of labor union rights of non-public enterprises.This paper studies the situation of non-public enterprises' rights protection,and analyzes the deficiency of non-public enterprises' rights protection in Gansu province,and puts forward measures and Suggestions for continuous improvement,which is of double significance.On the one hand,it is of great significance in theoretical research,and on the other hand,it has practical research value,which is of great significance to the construction of harmonious labor relations among non-public enterprises in China,and can also provide decision-making reference and reference for non-publicenterprise unions in other regions to safeguard the rights and interests of workers.This paper selects non-public enterprise trade unions in Gansu province as the research object.By means of data collection,literature review,questionnaire survey,interview and other research methods,this paper constructs an analytical framework based on the labor union rights protection concept of socialism with Chinese characteristics and harmonious society construction theory.This paper defines relevant core concepts and studies the current situation and effectiveness of non-public enterprises' rights protection in Gansu province.According to the research and analysis,problems such as insufficient effect of safeguarding rights,formalistic mechanism of safeguarding rights,low willingness of workers to choose union safeguarding rights,union's emphasis on organizing activities rather than safeguarding rights,lack of protection of workers' most concerned labor economic rights and interests,are the main problems existing in current non-public enterprises in Gansu province.Combined with the existing problems and investigation results,this paper explores the reasons affecting the effect of safeguarding rights,from the four dimensions of "subject of safeguarding rights","object of safeguarding rights","tool of safeguarding rights" and "mechanism of safeguarding rights".Finally,in view of the existing problems and the causes of the problems,combined with the actual situation of non-public enterprises in Gansu province,this paper proposes countermeasures to improve the actual effect of non-public enterprises' rights protection from the four dimensions of "subject of rights protection","object of rights protection","tool of rights protection" and "mechanism of rights protection".
