Research On Community Correction From The Perspective Of Social Governance

With the progress of human civilization,penalty gradually evolves to humanity,and human beings actively explore more reasonable penalty methods.As the main way of non custodial punishment,the introduction of community correction is not only in line with the trend of internationalization,but also an important system to improve the execution of punishment,promote the modernization of national governance system and governance capacity.Since 2003,community correction in China has been piloted for 17 years.On December 28,2019,the 15 th meeting of the Standing Committee of the 13 th National People's Congress voted to adopt the community correction law of the people's Republic of China(hereinafter referred to as the community correction law),which will come into force on July 1,2020.The promulgation and implementation of the community correction law fully embodies the modern penalty execution spirit of protecting human rights,combining leniency with strictness,scientific correction,social participation,restoration and integration,marking that the community correction work has entered an era in which there are laws to abide by,which is of great significance for promoting the legalization of community correction work and the modernization level of national governance system and governance capacity.The author works in the community correction center of Z District in Henan Province.He has practical experience in community correction and realizes the importance of community correction.Based on this,this paper takes Z district community correction center in Henan Province as an example,using literature analysis,case analysis,comparative analysis,social governance theory and new public management theory to analyze the current community correction problems.First of all,it analyzes the research background and significance of community correction from the perspective of social governance,combs the research status of community correction at home and abroad,and provides theoretical basis for the next research.Secondly,it introduces social governance,community correction and community correction law to better grasp the relationship between them;thirdly,it introduces the current situation of community correction practice in Z District,finds out the problems and causes in community correction work in Z District,and draws lessons from the development experience of community correction at home and abroad.Finally,using the method of combining theory with practice,this paper puts forward suggestions to improve the community correction from four aspects: the construction of organization team,the connection and cooperation of political and legal departments,work measures,and the participation of social forces,hoping to provide some references for the development of community correction in China in the future through this relatively systematic analysis.
