Study On Legislation Of Urban Rainwater Utilization In China

With the development of economy and the acceleration of urbanization in China,the following problems are beginning to appear.One of severe challenges is the treatment and utilization of urban rainwater.Due to the large hardening area of urban ground and the imperfection of rainwater drainage system,waterlogging has occurred in numerous Chinese cities in recent years and at the same time,most regions of China are faced with drought.If the urban rainwater can be used reasonably and effectively,the two seemingly unrelated problems can be solved simultaneously.China began to develop urban rainwater utilization in the 1980s,but up to now,there are still many deficiencies in the legal construction of urban rainwater utilization,China has not yet formed a sound legal system for urban rainwater utilization.The current laws are usually decentralized legislation,and there is no effective cooperation between laws.Although some local laws and regulations have been formulated at local level,due to the lack of legislative principles and clear guidance of the upper law,the content of local laws and regulations is not systematic,and there are many legal gaps.There.are also many deficiencies in the specific legal system in our country.At present,there is no clear subject of rainwater utilization management in our country,and the relevant subjects cannot coordinate efficiently;the urban rainwater utilization has not been included in the overall planning of the city;the supervision and punishment of urban rainwater utilization are not clearly defined in law.Comparatively speaking,,the legal system of urban rainwater utilization in some foreign countries is relatively perfect,the United States has formed a perfect legal system,and the legal system of rainwater utilization in Germany,Japan and other countries is also very advanced.Combined with the actual situation of our country and the practice of other countries,in the process of building the legal system of urban rainwater utilization,first of all,a special legislation with the nature of promotion should be formulated at national level to promote the development of urban rainwater utilization in our country.In the specific system,it is necessary to formulate management system,determining the main body of urban rainwater utilization management so as to coordinate the relationship between all parties;Our country should formulate urban rainwater utilization planning system and incorporate urban rainwater utilization into urban planning,formulate economic incentive system in planning and construction;We also need to formulate corresponding supervision and punishment system and strengthen the legal deterrent of urban rainwater utilization through supervision and punishment.It is a key step for the construction of the legal system of urban rainwater utilization in China to formulate the special legislation of urban rainwater utilization at local government level.It is in line with the purpose of adapting measures to local conditions,which can effectively promote the development of urban rainwater utilization in China and contribute to the construction of ecological civilization in China.
