Research On Legal Regulation Of Environmental Safety In Genetically Modified Biology

With the development of the times,the risks of the international community have increased.Global climate is warming,glaciers are melting,natural disasters occur frequently,and biodiversity is gradually decreasing.This article uses the theory of risk prevention principles as a reference,through an in-depth investigation of Village Y,to understand the villagers’ knowledge of genetically modified organisms.After investigation,it was found that the villagers of Village Y did not have a high level of awareness of genetically modified organisms.The core content of the theory of risk prevention principles is to take preventive measures against unknown risks.The unknown of transgenic technology increases the risk of environmental safety of transgenic organisms.The genetically modified biotechnology has developed rapidly in the 21 st century,and genetically modified environmental safety may be subject to environmental safety risks without scientific certification.In the report of the Nineteenth National Congress of the Communist Party of China,Comrade Xi Jinping proposed the goal of harmonious coexistence between man and nature and the construction of a beautiful China.Therefore,in this context,it is necessary to study the environmental safety of genetically modified organisms.This paper studies the legal regulation of environmental safety of genetically modified organisms from five aspects.The first part introduces the source and significance of this topic,then sorts the domestic and international literature on this topic and introduces the research methods of this paper.The second part introduces the proposal and the later development of the theory of Precautionary Principle.Because there are environmental risks before the scientific qualitative of genetically modified organisms,this theory is the theoretical support of this paper.Precautionary Principle is not only applied to the general environmental pollution,but also to prevent the environmental safety risk of genetically modified organisms abroad.The third part introduces the relevant legislation of environmental safety of genetically modified organisms in China,and analyzes the difficulties of legislation of genetically modified organisms in China.The fourth part introduces the laws and regulations and some systems of the GMOs safety legislation in the European Union,the United States,Australia and New Zealand.Through the introduction of the GMOs safety legislation in four countries and groups,we can draw some enlightenment on the GMOs safety legislation in China.The last part is some ideas about the GMOs safety legislation in China,including the formulation of the safety law of genetically modified organisms,the improvement of the supervision system of genetically modified organisms safety,the construction of the information sharing mechanism of genetically modified environment safety,the improvement of the responsibility system of genetically modified environment safety,and the establishment of the remedy system of genetically modified environment safety.
