Research On Legal Protection Of The Right To Avoid Poverty In Ethnic Areas

From the contradiction of limited resources and unlimited demand,poverty is inevitable,so anti-poverty is a hot topic.With the proposal "Freedom from poverty" and "Rights to freedom from poverty " made by international scholars,the topic of poverty has taken a new height.The right to freedom from poverty is recognized internationally.As for how to protect the right to freedom from poverty,there are still obvious deficiencies in practice.Therefore,it is of great theoretical and practical significance to conduct systematic research on this,to explore the basic principles of the right to freedom from poverty,and to seek a basic path for constructing a scientific,reasonable and operable legal security system.Ethnic areas still exist regional poverty.How to use the theory related to the right to freedom from poverty to analyze China's anti-poverty legislation in ethnic areas,reveal its problems and reasons,and then propose perfect countermeasures against the legal protection of poverty rights.It is the main content of this article.This article is divided into four parts.The first part is an overview of the right to freedom from poverty.Understanding the right to freedom from poverty from the meaning of poverty and the right to freedom from poverty.It is a right to free people from poverty and lead a decent life.Further explore the constituent elements of the rights to freedom from poverty in ethnic areas,namely subject,object and content,and analyze their basic characteristics.The second part is a legal analysis of the legal protection of the right to freedom from poverty in ethnic areas,from four aspects:human rights verification,substantive justice,proof of legal norms and obligation requirements;The third part is an analysis of the problems and causes of the legal protection of the rights to freedom from poverty in ethnic areas.First,analyze the legislation and implementation status of legal protection.Secondly,raise the existing problems including legislative flaws,inadequate supervision mechanism,imperfect judicial relief system;finally,analyze the reasons for their problems.The fourth part proposes the perfect countermeasures for the legal protection of the right to freedom from poverty in ethnic areas,which is improved from two aspects of the legal system and the legal guarantee operation mechanism.
