Research On Diversified Governance Of Online Speech Violence In China

In recent years,online speech violence has occurred frequently,which not only damages the legal rights of other online users,but also seriously affects the peace of the entire country.Therefore,how to use the rule of law thinking to govern the cyberspace,bring Internet construction into the track of the legal system,and conduct in-depth discussions,whether in the theoretical or practical circles,are issues that need to be solved urgently.The thesis aims at optimizing the governance path of online speech violence,and always focuses on the practical issue of legal regulation of online speech violence.The article first sorts out the existing doctrines.There are currently two viewpoints in the academic circle: language theory and behavior theory.Behavior theory includes three branch theories: public opinion behavior theory,tort behavior theory,and criminal behavior theory,and then combines the context and elements of online speech violence Considering factors such as,influence,etc.,reconstruct existing concepts to improve theoretical basis.Secondly,it analyzes the existing governance measures of online speech violence,and sorts out the problems existing in the existing measures,such as insufficient legal protection,weak self-discipline of industry organizations,and weak self-discipline awareness of netizens.The overall situation is fragmented and no governance synergy has been formed.Finally,three countries outside the region,including the United States,Germany,and Australia,were selected to analyze and summarize the countermeasures against the same online speech violence problem,and to refine useful experience.This article believes that the diversified analysis of the legal regulation of online speech violence and the improvement of the existing Internet legal system should start from the three main bodies of the government,industry,and netizens,through the formulation of relevant laws and regulations,the improvement of scientific law enforcement systems,and the improvement of judicial judgments.Rules,strengthen industry self-discipline,and enhance the self-discipline awareness of netizens;strengthen exchanges and cooperation between countries,seek a balance of measures among many governance entities,use legal rules to solve problems,jointly respond to online speech violence,and protect online users Rights,to purify the network ecological environment.
