Research On Reproductive Rights Of Single Women

In recent years,there are more and more disputes about the birth right of single women.On the one hand,this phenomenon reflects the emancipation of women’s minds,women are no longer bound by the traditional marriage and family model.On the other hand,single women’s pursuit of reproductive rights is a reflection of the openness and acceptance of social reproductive concepts.Through the analysis of the relevant legal provisions of China,combined with the international community’s definition of the right to bear,this paper puts forward its own views on the definition,scope,characteristics,subject,nature and content of the right to bear of single women.The legislative review of the reproductive rights of single women in China by analyzing the defects of domestic legislation,we can conclude that there are some defects,such as the big difference of legislation on the reproductive right of single women,the unclear social collection fees and the inapplicability of reproductive technology to single people.At the same time,we can analyze the reasons for these defects and analyze the adverse consequences.By comparing the legislative status of single women’s reproductive rights in common law countries and civil law countries,the paper concludes that the construction of single women’s reproductive rights is necessary and meets the requirements of international human rights protection.The last but not least is the construction of the birth right system of single women in China.The establishment of the protection and relief system for single female’s childbearing rights can be achieved through the improvement of basic principles,the establishment of special institutions,the formulation of subsidy policy,the improvement of registration system and guardianship system,and the cancellation of the alimony etc.The relevant administrative law and civil law relief system are introduced to establish a relatively perfect legal system.Figure 0;Table 0;Reference 41...
