Research On The Influence Of Judicial Efficiency On Technological Innovation Of Enterprises

The intellectual property rights formed by enterprises through technological innovation activities have an important role to play in patent applications,knowledge financing,and even forming their own core competitiveness.From the perspective of law and economics,intellectual property rights are a kind of “monopoly power”.The formation of such a monopoly power will increase the cost of infringement of technological innovation results,can effectively prevent plagiarism,and then encourage enterprises to conduct technological innovation and increase the intellectual property rights.Output and subsequent transactions and circulation.At present,in the enforcement of infringement protection in China's intellectual property system,there are problems such as difficulty in obtaining evidence for patent infringement,long cycles,high costs,and low compensation.These problems have inhibited the technological innovation input and output of enterprises.It can be seen that the efficiency of the judiciary in the implementation process will significantly affect the actual effect of the system in the market environment,and then affect corporate behaviors such as technological innovation.The paper discusses the impact of judicial efficiency on the technological innovation of enterprises in the provinces of China.First,based on the theory of property rights and transaction costs,the paper sorts out the transmission mechanism of judicial efficiency affecting enterprises' technological innovation and the intermediary role played by intellectual property protection.Secondly,the paper uses the data envelopment analysis method to measure the judicial efficiency levels of courts in Chinese provinces from 2014 to 2018,and uses the principal component analysis and factor analysis methods to calculate the respective provinces' enforcement intensity of intellectual property protection(IPRE).After comparing the judicial efficiency and IPRE,the paper makes panel data regression to measure the impact of judicial efficiency on the technological innovation output of enpterprises and the intermediary effect of IPRE.The measurement results of the indicators show that China's overall level of judicial efficiency is in a low level,and there are significant regional differences of judicial efficiency among all the provinces.From the perspective of time,it shows a year-by-year increasing trend.From the perspective of regions,the eastern region has the highest overall efficiency level,followed by the central region.The judicial efficiency level of west region is the lowest,it has the largest growth rate.The intensity of IPRE shows the same regional distribution differences and growth trends.The results of the panel data model show that judicial efficiency has a significant promotion effect on the technological innovation in enterprises.The impact coefficient of technical efficiency is the largest,indicating that the increase of both judicial input and the improvement of management level can maximize the utility of judicial institutions.In addition,the IPRE shows a significant intermediary effect.This intermediary effect occupies 41.87% of the total effect of judicial efficiency,indicating that the judicial protection of intellectual property rights has played an important role in stimulating the judicial efficiency of technological innovation.Finally,the paper draws conclusions based on the research results above,and summarizes the enlightenment for China.
