The Third Plenary Session of the Eighteenth Central Committee of the Party pointed out: "In the process of comprehensively advancing the construction of the rule of law in China,we must consolidate the consensus of reform on the rule of law.Higher requirements require the rule of law to further promote deepening reform.Under such a background,legislation leads and promotes local reform as a new research topic.Therefore,research on how to lead and promote the development of local reform through legislation is of great significance for the local reforms in the new era to always adhere to the correct direction and walk on the right path.From the beginning of reform and opening up,the relationship between legislation and reform has now entered a new period of comprehensive deepening of reform.It has gone through three stages: from the confirmation of reform results by legislation to the progress of legislative guarantee reform to the guidance and promotion of reform by legislation.Therefore,the relationship between legislation and reform in the new era has gradually changed to lead and promote reform through legislation.That is,when local governments are involved in reform matters or when new reform measures are introduced,they must rely on legal provisions or legal authorization to give play to legislation in reform Leading and promoting role in the process.However,legislation leads and promotes local reforms as a new exploration of local integration in the field of deep integration reform and legislation.It is still in its infancy,and all aspects of the work are not very mature.Thinking and summarizing reform methods from the perspective of legislation is still There are many problems that need to be solved,such as insufficient local legislative capacity,incomplete legislative working mechanism,low public participation,lack of high-quality talents related to legislation,and some local people 's congresses tend to be conservative or ideological in the face of this new job Problems such as the lack of close connection between legislative content and reform practice.In recent years,various regions have also conducted in-depth explorations on the practice of leading and promoting reforms by legislation.Among them,the practical experience and achievements of Shanxi Province have attracted much attention,and they have taken the lead in China.The experience of Shanxi's legislative leadership and promotion of local reforms can be summarized as follows: adhere to the legislative mechanism led and coordinated by the National People's Congress;focus on the difficulties of reform and make legislation more precise;legislation should use local legislative space without violating the upper law;Strengthen the legislative functions of the committees of the National People's Congress,strengthen the building of the legislative team,etc.It is a long-term and arduous task to further promote legislative guidance and promote local reforms.This article specifically proposes six countermeasures and suggestions on how to improve the practical work of legislative guidance and promote local reforms,based on the practical experience of Shanxi Province: Breakthroughs in local reforms,forming clear legislative ideas;improving legislative working mechanisms and encouraging special authorized legislation;innovating the content and form of the legal system to meet the actual needs of local reforms;starting from local realities,enhancing local features of legislation;continuing to expand public participation Legislation,improve the feedback mechanism;pay attention to talent training and introduction,and constantly improve the level of local legislation.The author combines theory with practice,on the basis of studying and summarizing the basic practices and practical experience of Shanxi Province to lead and promote local reforms by legislation,and puts forward some thoughts and suggestions,hoping this research can help to explore and improve the local legislative system and achieve the goal of promoting local reform and development.
