Research On The Influence Of Public Opinion On Criminal Justice

In recent years,public opinion has been strongly involved in criminal justice cases in China,which has a huge impact on criminal justice activities.How to deal with public opinion effectively in criminal justice activities has become a key issue.Based on the analysis of 90 public opinion cases selected from China's judicial documents network,no litigation network and Beijing University magic weapon network,this paper combing out the specific manifestations of the impact of public opinion on judicial activities,and analyzes the causes,hoping to put forward new ideas on how judicial organs should respond to public opinion.This paper is divided into four parts:The first chapter is the case analysis and combing.Taking 90 judicial cases as samples,this paper makes a basic analysis of the cases,leading to the key issues that the current public opinion has a dramatic impact on the judiciary.Secondly,it systematically analyzes the cases and summarizes the specific status of the current public opinion on the judicial impact from two aspects: first,the positive impact of public opinion cases on the judiciary;second,the negative impact of public opinion cases on the judiciary.And then trigger its thinking of the current situation.The second chapter is the causes of the influence of public opinion cases on judicial decisions.Through the specific combing of the case,the reasons are analyzed from the following four aspects: first,the judicial organ fails to comb and respond to the public opinion in time;second,the judge uses the law mechanically without considering the common sense;third,the contradiction between the simple values of the people and the justice of the judicial procedure;fourth,the conflict between the public opinion and the justice is analyzed.The third chapter is the three principles of the judiciary to deal with public opinion.It is analyzed from three aspects: first,the principle of justice for the people is the basis of public opinion response;second,the principle of judicial justice is the basis of public opinion response;third,the principle of human rights judicial protection is the principle of public opinion response.The fourth chapter is the path choice of judicial organs to deal with public opinion.First of all,it analyzes from the establishment and improvement of the normal handling mechanism of the judiciary;secondly,it analyzes from the strengthening of the concept consciousness transformation of judicial personnel;thirdly,it analyzes from the strengthening of the rational legal thinking of the public;finally,Improve the judicial regulation of public opinion involving law.
