Research On The Structure And System Of The Policy And Regulation Of Industry-University-Research Cooperation In China

Industry-university-research cooperation is one of the important ways to promote the progress of science and technology.Through the in-depth cooperation of each other,we can give full play to the important role of technological innovation in the development of social economy,so as to promote the improvement of the level of social productivity.In recent years,the state has put great emphasis on the improvement of independent innovation ability,and taken scientific and technological innovation as an important strategic choice to promote the construction of national innovation system.The government departments have also formulated a number of policies and regulations.The legal policy of industry university research cooperation is the fundamental method to guide technological innovation.However,due to the slow start of domestic research cooperation,relevant laws and regulations are still not sound.Specifically,there are still defects in the structure and system of laws and regulations,it cannot be connected with many links of industry-university-research cooperation,and it can not meet the needs of the further development of industry-university-research cooperation in China.Based on the summary and analysis of the existing research results,this paper comprehensively uses the text analysis method and case analysis method.Based on the text analysis of the level and system of the legal system of industry-university-research cooperation,and combined with the actual cases in the process of technological innovation,this paper points out the insufficient existing in the domestic legal system of learning and research cooperation,and puts forward reasonable suggestions.This paper first expounds the characteristics and basic requirements of the structure and system of policies and regulations of industry-university-research cooperation in China.According to the structure and system of policies and regulations,the author constructs and explains the policies and regulations of enterprises,universities and research institutes.It also puts forward the basic requirements for the structure and system of policies and regulations tobe carried out smoothly.Secondly,it analyzes the legal system of industry university research cooperation from two dimensions of level and system.In terms of the level of legal system,there is a lack of special legislation to promote the cooperation between industry-university-research,the guidance of departmental rules are insufficient,and the policy implementation of local laws and regulations is insufficient.In terms of the legal system,the responsibility and right of the technological innovation subject are not clearly defined,the ownership of property rights and the distribution of interests are not clear,the science and technology intermediary system is not perfect,there are loopholes in the management of scientific research funds,and the achievement transformation system is not perfect.Then,it selects several examples of cooperation between industry,University and Research Institute for case analysis.This paper analyzes the legal system problems reflected in the cases from the aspects of the use of scientific research funds,achievement transformation,technology evaluation,scientific and technological intermediary institutions and patent protection.Finally,some suggestions are put forward to improve the legal system of academic research in China.In terms of structure,we should pay attention to the development of national laws and administrative regulations,strengthen the policy orientation of departmental regulations,and pay attention to the specific implementation of local regulations.In terms of system,we should improve the legal system of innovation subjects,strengthen the protection of intellectual property rights,strengthen the management of scientific research,improve the service system of science and technology intermediary,and promote the transformation and application of scientific research achievements.
