Investigation Report On Administrative Law Enforcement Of Illegal Carriage Of Prohibited Goods At Baiyun Airport

With the continuous development of social economy,civil aviation transport industry at home and abroad has also maintained a high-speed development trend.More and more passengers choose civil aviation in their mode of travel.Accompanied by this,the passengers'awareness of rights has been constantly enhanced.In order to satisfy their own selfish desires,the attempt to pass security checks on embargoed items such as fires,knives and so on has occurred from time to time.Civil aviation security inspection is the last line of defense to prevent illegal carrying of embargoed goods.The law enforcement of airport public security against illegal carrying of embargoed goods by passengers is an important part of ensuring air defense safety.The law enforcement of illegal carrying of embargoed goods is a prominent administrative law enforcement activity in airport public security work in recent years.In this paper,the author selected the cases of illegal carrying of embargoed goods handled by Baiyun Airport Public Security as the research sample,collected and analyzed the cases of illegal carrying of embargoed goods handled by Baiyun Airport Public Security in recent years,and studied the cases of illegal carrying of embargoed goods at Baiyun Airport by means of investigation,empirical research and other research methods,including the number of cases,the trend of occurrence,the type of cases and the characteristics of cases.At the same time,the law enforcement situation of Baiyun Airport public security in such cases is analyzed.It is found that there are some problems in the enforcement of such cases by airport public security,such as inconsistent punishment standards for the same kind of illegal acts,arbitrary enforcement of law caused by sport-style enforcement,anomie of enforcement procedures,etc.The reasons include unclear regulations on the types of embargoed articles in civil aviation,lack of relevant provisions on the constitutive conditions of illegal carrying of embargoed articles,and lack of action.The discretion of political punishment lacks necessary rules,the punishment means for such violations are single,and the law enforcement lacks effective supervision.In this regard,to further improve the administrative law enforcement in cases of illegal carrying of embargoed articles,the author puts forward the following suggestions:first,unify the specific categories of the embargoed articles in civil aviation;second,clarify the identification criteria of the mode of illegal carrying of embargoed articles;third,introduce the guiding opinions of the standard system of administrative penalty discretion;fourth,enrich the means of administrative penalties for illegal carrying of embargoed articles;The standardization of airport public security law enforcement is promoted through strengthening the construction of law enforcement team,standardizing the procedures of handling cases and strengthening the supervision of law enforcement.
