The modernization of Chinese law began in the late Qing Dynasty which the period of translating the western codes,however,there is no unified conclusion on the origin of this translation in the late Qing Dynasty,and there are few related research results.The research object of this article,"The French Law"(Chinese translation)is the first complete code of modern Western input into China.The time of this translation is far earlier than the Reform Movement of the Law of the Qing Dynasty.Its research value lies in:First,studying of the translation can have a better understanding of the origin of the translation,and it has a status and significance that cannot be ignored in the fields of Chinese legal history,comparative law,and Chinese-French cultural exchange history;second,Codex translation is a part of the legal transplant.Studyingon the Chinese translation of the French Law is also of great traceability to understand the transplantation of modern Chinese legal system.At present,the research results of this translation are less,just concludes Liguilian,Wang Jian,Wanqizhou and others,but their research jusy mainly focus on the translation background,the articles structure,the different Chinese translation contrast,the translation of the Codex structure,principles,terms,the ideas behind the concept is not involved.In view of this,this paper mainly analyzes the legal terms used in the translation of French statutes and by comparing it with the revised code in the late Qing dynasty,the author analyzes the role of this translation in the revision process of the late Qing dynasty and the specific reasons.This paper is divided into three chapters:The first chapter is mainly to describe the French statutes background of the translation,translators,translation,translation of different versions,and the specific situation,and analyzing the structure of the translation as well as the translation of the specific provisions after the more comprehensive medium of the translation.And through the study of legal terminology in translation of selected the analysis of the research of translation in the process of Chinese traditional legal concepts and convergence and collision of western modern legal thoughts.The second chapter mainly compares the French statute with new criminal law of Qing dynasty,the imperial Qing dynasty commercial law,the draft criminal procedure law of the Qing dynasty and the relevant codes of Germany and Japan,and analyzes the reference degree of the French statute in the revision process of the law in the late Qing dynasty from this perspective.The third chapter mainly analyzes the reasons for the reference of the French statute at the end of the Qing dynasty,and the enlightenment of the translation of the French statute at the end of the Qing dynasty.Through the analysis of the above three chapters,on the one hand,it explains the important role of the Chinese translation of the French statute for the study of the translation of western law;on the other hand,it has a deeper understanding of the French statute,which have great significance of The Times,through the French statute and other codes enacted in the late Qing dynasty.
