With the fast economic development of China, the environment problem has been more and more apparent. Medical waste management is also becoming one of the focuses of the society. As the medical waste is the first hazardous waste in national catalog of hazardous wastes which it has the features of high danger and disposal of professionalism and difficult collection and hard degradability, it should be strictly managed in order to reduce the loss, the secondary pollution caused in the disposal process, to prevent environmental pollution and the spread of disease. The state system of the medical waste management is the key link to solve environmental problems of medical waste. It is a variety of legal norms about the policy objectives to the waste management to effectively address the fundamental problem of medical waste and the measures, procedures methods and other legal norms to develop and to achieve the target. In June 2003 the state introduced the "Medical Waste Management Regulations" and the subsequent introduction of appropriate supporting legislation, which made our medical waste management pace into a legal process. However, there are still some problems in the system such as the legal system, basic principle, legal subjects, medical waste classification, economic incentives system, charging system. In view of the problems of the medical waste management system, referring to the experience of medical waste management system of the developed countries, we should develop the system of medical waste management from the following aspects, (1)Sound legal system of medical waste management, modifying the corresponding provisions of existing legislation in order to maintain the upper and lower law coherent and of the law careful, (2) Establish principles of medical waste management legislation to provide guidelines for the future development of the legal provision of medical waste management, including the principle of "3R", of encouraging technological innovation, of information disclosure, of public participation, (3)make the subjects of legal relationship of the main medical waste management clear,(4) classify medical waste Scientifically and concretely. (5) Establish effective economic incentives such as creating deposit system in the course of medical waste recovery system, to increasing government subsidies and tax breaks and other preferential policies to the disposal of industry, appropriate to encourage the development of medical waste disposal industry and to create the fund of the hazardous materials to respond to the emergency of the medical waste leak, (6) improve the fee system of the medical waste disposal following the sewage pays principle. |
