Research On Policy And Legal Issues Of Gansu New Energy Strategy Implementation

Gansu,which is located in the prime location of the Belt and Road Economic Belt,has unique advantages in implementing the “Belt and Road” initiative,accelerating the development of new energy,and strengthening international cooperation in energy.In 2013,General Secretary Xi Jinping proposed that "we must focus on promoting the strategic adjustment of Gansu's economic structure,vigorously support the development of strategic emerging industries,and build an important new energy and new energy equipment manufacturing base in the country." The Hexi region is an important ecological security barrier in the west and a blessed place for new energy development and construction.Nevertheless,in the implementation of Hexi's new energy strategy,there are still problems such as abandoning wind and electricity,lagging market development,insufficient government regulation,and limited development of power grid technology.At the same time,its legal disputes are also increasing.Related issues in the development and utilization of new energy,risk prevention,contradictions in land acquisition for new energy projects and environmental public interest litigation are also intensifying.Through a review and analysis of the new energy cases in Gansu Province in the past two years,it is found that the existing laws and regulations in the actual development and utilization of new energy are either lagging or too principled or lack of pertinence,and are not operable,etc.;there is a price mechanism in law enforcement Problems,lack of financial support,quota system,insufficient administrative guidance,and discrepancies in legal norms and practice.After sorting out and summarizing the development trends of new energy laws and policies in developed countries,we can learn from them.Developed countries are advancing legislative improvement and strict law enforcement in the development of new energy,paying attention to the role of market regulation,taking low carbon as the guiding direction,and increasing international cooperation.To solve the legal problems in the development and utilization of new energy in Hexi,Gansu,first of all,we should improve the new energy legislation,on this basis,establish a systematic new energy development legal system,and improve the corresponding legal system;second,the law enforcement level strictly enforces and regulates law enforcement.Finally,clarify the relationship between laws and policies,use policy adjustments reasonably in the development of new energy,play a market role,and encourage people to participate in it to ensure the smooth implementation of Gansu 's new energy strategy.
