Sponge City construction is an important way to solve the urban flood disaster and water resource shortage.It is also an important measure to maintain the stability of urban ecosystem,optimize urban ecosystem and maintain urban ecological health.A comprehensive survey of the specific practice and system supply of Sponge City construction pilot cities and other cities in China shows that the construction of sponge city has encountered many policy and legal constraints and needs to be studied and cracked.Following the sequence of "planning a map,building as a whole and managing a net",focusing on the main legal problems existing in the construction of Sponge City,this paper will focus on the planning legal problems before the construction,the legal problems in the specific construction and the legal problems in the management system.Based on the definition and functional orientation of Sponge City,combined with the policy and legal basis and system practice of Sponge City,the paper follows the overall idea of putting forward problems,analyzing problems and solving problems,so as to seek legal countermeasures to promote the construction of Sponge City in China according to law.First of all,for the legal problems existing in the planning before the construction of Sponge City,such as the low level of legal basis,the lack of in-depth change of legislative concept,the imperfect legal responsibility system of supervision,the neglect of "ecological background" and the outstanding "fragmentation" of unclear levels,the corresponding legal countermeasures and system construction suggestions are put forward: to improve the level of planning legislation,and to use the relevant concepts of Sponge city To carry out the whole process of planning legislation,clarify the supervision responsibility of planning implementation,strengthen the system construction of planning basis,clarify the planning level and pay attention to convergence.At the same time,the construction of "three systems" and "one platform" is essential to improve the legislation of sponge city planning.Secondly,for the legal problems in the specific construction of Sponge City,such as imperfect professional standards,single operation mode,large gap between construction funds and talents,imperfect construction operation and management system,imperfect performance appraisal mechanism,etc.,it is proposed that the standard system of sponge city construction should be improved,and the mode of "combination of gray and green facilities " and "sponge plus" should be adopted for construction,so as to improve the Sponge City.The city's policy incentive system,improve the operation system and the whole process management and control system.Finally,for the legal problems existing in the management system of Sponge City,such as the low level of legislation,the imperfect management mechanism,and the lack of assessment and supervision content,suggestions are put forward to improve the legal and regulatory system and establish a sound supervision and restriction mechanism.At the level of concrete improvement of the government management system of Sponge City construction,it is proposed that the functions of various departments of Sponge City office should be detailed,the normalization of joint conference of Sponge City management should be promoted,and the linkage mechanism of water control at the grass-roots level should be established.
