Research On Special Regulations Of Mongolia Autonomous Region In The Past 40 Years Of Reform And Opening Up

Since the reform and opening up,the legal system of national autonomy has been basically established in China,but the study on the legislation of national regional autonomy is relatively weak.According to statistics,the Inner Mongolia autonomous region 40 years since the reform and opening up,the current effective 31 separate regulations,this article mainly to the present the first-hand,olunchun dawoer community-molidawa dawoer autonomous county in the first-hand,first-hand place such as separate regulations as the research object,through the analysis found that the above special decree characteristics to keep up with the political reform and development of new ideas,to cater to the economic construction and social development economic characteristics,reflects the protection of the rights and interests of minority national characteristics.Analysis of special legislation to coordinate resources development and the current minority income rights,ecological environment protection and sustainable development of the minority cultural heritage and rights,market economy oriented the contradiction between trading with ethnic minorities equal rights and interests,to promote special decree legalization construction,national security interests,promoting the local economic development play an important role in such aspects.At the present stage,there are many problems in the legislation of special regulations,such as insufficient exercise of legislative power,non-standard legislative procedure and legislative technology,lack ofsupervision,limited resolution of contradictions between reform and opening up and ethnic minorities.In view of the above problems,the author suggests that from the perspective of legislative review procedures,the positioning of approval and review standards,highlighting the national characteristics of the legislative content of the special regulations and strengthening the coordinating role of the special regulations,the legal principles should be organically combined with the practical issues,and the legislation of the special regulations should be improved and strengthened.
