Research On The Legal Dilemma And The Way Out Of The Management System In Jiangdong New District Of Heyuan City

Urban new district is a system innovation in the process of urbanization.As a kind of system innovation,how to set up the management system of urban new district is the key factor of the development trend for the staff.Up to now,only Shanghai Pudong new district and Tianjin Binhai new district have set up first-class government,and the management system has developed well.In the process of the rapid rise of other new urban districts,management committees are often set up as the management system of the new district,which has a strong "large-scale system" feature,helping the new district to "put on the line lightly" and concentrate on economic development.However,under the background of less research on the management system of non-state-level new districts and lack of relative laws and regulations,the management mode and operation mode of the "management committee" system is not mature enough,so as to the economic and social management functions that need to be undertaken in practice cannot be responded in time by legislation,which brings many legal dilemmas to the management system of urban new districts.As a non-state-level new district,Heyuan Jiangdong new district sets up a management committee to conduct unified leadership and management of the new district,which has many common characteristics with most of the other non-state-level new districts,and the legal dilemma faced by its management system is similar to most of the other non-state-level new districts.Based on the definition of the concept of the new urban district,the report comprehensively reviews the historical development of the new urban district,scientifically analyzes the functional orientation of the new urban district,and comprehensively grasps the current situation of the management system of Heyuan Jiangdong new district as well as the legal difficulties such as the vague legal status of the main body of the management committee,the lack of law enforcement guarantee and the lack of power supervision mechanism in the new district.From the two aspects of central and local legislation,this paper analyzes the reasons for the legal dilemma of Heyuan Jiangdong new district.Based on the experience of the management system development of other new urban districts,it is proposed that local legislation isthe most appropriate choice to solve the legal dilemma of the management system of Heyuan Jiangdong new district.It is also proposed that through the introduction of local laws and regulations related to Heyuan Jiangdong new district,the legal position of the Management Committee of the new district should be clarified,the management system of the new district should be innovated,the law enforcement guarantee mechanism of the new district should be improved,and the supervision of power operation should be established and perfected Governor mechanism.The solution of the legal dilemma of the management system is conducive to building a better business environment,implementing more standardized social affairs management,providing better public services for people's livelihood,and laying a foundation for further scientific and healthy development of the new district.
