In recent years,the market economy has shown inclusive and open development,and private demand for capital has also grown stronger.With the rapid expansion of the private lending market,the use of private lending as a cover to carry out "trick loaning" illegal crimes that illegally possess others’ property has continued to breed and spread rapidly in China.Such cases have a large number of victims and a wide range of influences.They are often intertwined with evil forces,which can easily induce various types of violent and mass incidents,which seriously endanger social stability,market economic order and the safety of citizens’ personal property.Such crimes have become one of the major "cancers" that endanger the country.The resulting investigation problems need to be resolved urgently,and the investigation departments must respond to new situations in a timely manner,ensure precision and proactively crack down on crimes,and effectively curb the occurrence and spread of "trick loaning" cases.Based on the challenges brought by the "trick loaning" case to the investigation in the new situation,this article first briefly summarizes the "trick loaning" and starts with the definition of the "trick loaning" to describe the current situation of crime,the basic structure and the form of expression.An analysis of applicable laws is also conducted.Secondly,the "trick loaning" case is different from ordinary criminal cases.It has five main characteristics: "legalization" of the criminal form,the seriality of the "trick" design,the universalization of the spiritual threat,the corporatization of the operating process and the non-contact nature of the criminal model.In this context,the authors through literature research,investigation interviews and case analysis in criminal judgments,according to the analysis of the case handling process,sort out the key to the detection of "trick loaning" cases is to break through the difficulties in initial investigation,recovery of stolen goods,obtaining evidence,deep digging and expansion,and investigation cooperation.In order to solve the investigation dilemma,a targeted investigation countermeasure is proposed.First of all,it is necessary to use intelligence information to actively expand the channel of leads.Secondly,investigators as the main body should also improve their screening ability and accurately apply the law.During the entire investigation process,we must pay attention to grasping the key points of evidence collection around the "trick" and constructing a complete evidence chain;always strengthen the work of judging cases in parallel and expand innovative techniques and tactics;focus on establishing a case cooperation mechanism.In short,only by exerting the power of multi-party co-governance and multi-pronged approach can we achieve an active,systematic and integrated crackdown on "trick loaning" cases,thereby maintaining financial and economic order and ensuring social harmony and stability.
