| By referring to the Wage Protection Fund system of Hong Kong、Taiwan and Shenzhen,Shanghai established initially its own Wage Protection Fund system in 1999 through the form of local regulations,basing on its actual domestic situation.With more than 10 years development,Shanghai Wage Protection Fund system upholding the principle of social relief、emergency help and limited use,has been becoming the last protective barrier of laborer rights,which gives huge help to the people who are suffering from the unpaid wages.Shanghai Wage Protection Fund has paid 93.53 million wages and economic compensation to eight thousand workers from 230 enterprises.With the continuous expanding usage of Shanghai Wage Protection Fund,the usage problem behind the system has influenced the development of the system itself.It also has caused the dispute from the enterprises and the public.So it is necessary to research and analysis the problem from the design and implement of the system,and then put forward advices and suggestions for solving the problem.This article focuses the study view onto the usage system of Shanghai Wage Protection Fund.The thesis is divided into five parts.Before raising the issues,it firstly reviews the research background of the Shanghai Wage Usage Protection Fund system,including the significance of research、 the definition of concept 、 the research technique、objective and the innovation.Secondly,it reviews the background of establishing the Shanghai Wage Protection Fund Usage system and its development,including its characteristic、achievements and problems.Thirdly,this article gives analysis to current usage situation of the Shanghai Wage Protection Fund taking Jinshan District as an example,then puts forward related problems and analysis the causes of the problems.Fourthly,it compares the domestic wage protection usage system with foreign usage system in order to sum up the experience and inspiration.Last,it gives the advices to solving the problems in order to improve the Shanghai Wage Protection Fund Usage system to protect the legal rights of labors.In general,the article argues that the improvement of usage system of Shanghai Wage Protection Fund has important significance for the development of the system.The credibility and satisfaction of the Shanghai Wage Protection Fund can be improved by following methods: establishing a specialized agency to supervise the fund and strengthening the recovery of the fund;lowering the threshold of usage of the fund and increasing the means of confirming the amount;expanding the scope of usage and arranging the order of usage reasonably;raising the limit of usage and improving the computing method of usage.And then the Shanghai Wage Protection Usage Fund will play a greater role in the future. |
