A Study Of The Crisis Of Doctor-patient Trust Based On The Perspective Of Rights Conflict

With the further advance of the market economy and the development of health care reform,medical and health services of our country have gradually became a high-risk field in the period of social transformation period.One of the distinctive characteristics is the escalating crisis of trusts between doctors and patients.In particular,the vicious medical disputesarise from unsettled rights conflicts are the focus of social media and relevant government departments.The reasons of Doctor-Patient trusts crisis are various,lack of trusts is resulted from individuals' realization of the lack and deprivation of their rights in the interpersonal process,and thus its crux is the rights conflict between doctors and patients.Based on empirical surveys of the current trust value of patients,this paper analyzes the types of conflicts of rights in some specific dispute cases.The analysis concludes that doctor-patient dispute is a symptom of the rights conflict between doctors and patients.The building of doctor-patient trust has experienced the diffusion period from targeted trust to general trust.On the three analysis levels of general trust,rights conflict led to the failure diffusion and damage of general trust,so the author concluded that the core of the crisis of trust between patient and physicianis the conflicts of rights between doctor and patient,and then in the three levels,the author combined with the real instance summarized the principle of resolving right conflicts,and giving the countermeasures for the reconstruction of doctor-patient trust.This article is divided into introduction,text and epilogue three parts.The text has six chapters.Chapter 1:Defined the concept of trusts between doctors and patients,and divided three kinds of doctorsand patients' trust crisisaccording to the form of doctor-patient relationship.The article listed the rights of the doctors and the patients in the interaction between doctors and patients,and defines the concept of the conflict of rights and the mediation of rights.Chapter 2:Through the examples from United States,Britain and Japan,the article concluded the abroad situation of doctor-patient crisis and empirically investigated the present situation of doctor-patient crisis in our country from three respects ofthe social transformation,the media influence and both doctors and patients attitudes.Through the questionnaire survey,the author investigated the doctors and patients' attitude towards the future development of doctor-patient trust.Chapter 3:Through the three major medical dispute cases of S hospital,the article analyzed the specific conflict types of the medical rights indetail.After the empirical investigation of the relationship between doctor-patient dispute^ doctor-patient trust and the conflict of the rights,the author concluded that medical disputes and doctor-patient trustcrisis are reciprocal causation,medical disputes is the external representation ofdoctor-patient conflict of rights.Chapter 4:With three analysis dimensions of the general trust theory,the article explored the core of doctor-patient trust crisis from individual social actors,social interactions and social environment system three aspects.After analysis,it is concluded that the core of doctor-patient trust crisis is the rights conflicts between patient and doctors.Chapter 5:The article explored legal principles and the moral guidance method for the coordination of conflicts between doctor-patient rights fromthe three dimensions of trust theory,namely individual social actors,social interactionsand social environment system.Chapter 6:From three respects of the reconstruction of doctor-patient positive trusts,perfecting the legal system construction in the field of medical andthe social environment of the doctor-patient relationship,the articlegavethe strategies and suggestions forthe reconstruction of doctor-patient trust.
