Study On Withdrawal Mechanism Of Private Colleges And Universities

Since the shutdown of jiangsu pell vocational college in 2004,the "wave of failure" of private colleges and universities in China has spread from non-academic institutions of higher education to private colleges and universities.Since then,a large number of private colleges and universities have closed down or been merged.At present,the classified management of for-profit and non-profit private colleges and universities will further standardize the school-running behavior of private colleges and universities,reduce the space of "seeking profits illegally",and invest in school running to obtain the legal status,which will increase the exit risk of private colleges and universities.Private colleges and universities that are not competitive enough and cannot be improved can only exit.However,as for the answer to the question of how to withdraw from private colleges and universities,China's relevant legal system seems to be "weak".Except for the general requirements and general expressions of appeal,it is difficult to find a corresponding system construction.Based on this,in the starting point of the classified management of for-profit and non-profit private colleges and universities,the author draw lessons from the Taiwan related experience,the feasibility and necessity of classification to exit mechanism is discussed,points out the outstanding problems and causes and try to put forward the solution of classification exit mechanism of for-profit and nonprofit private colleges:pre-warning-matter intervention-post-guarantee.Specifically speaking,pre-warning solves the problem of withdrawal objects,that is,what kind of private colleges and universities must withdraw.Because of the particularity of higher education,private colleges and universities are not "retreat if you want to retreat,retreat if you say so".Intervention solves the problem of how to withdraw,that is,a series of processes involved in the withdrawal,including the application of laws,withdrawal methods,withdrawal procedures and withdrawal consequences.For-profit and non-profit private colleges are different in nature,so their withdrawal process should be different.And post-guarantee is to strengthen supervision and implement mechanism.Due to the complexity of private universities exit interests involved,often restricted by the interests of all parties the subject,the biggest resistance comes from the main body and the government,should be take measures to ensure the necessary exit of private colleges smoothly exit,so as not to cause bad effect spread of the consequences.
