Reserch On The Protection Of College Student' Rihets From The Perspective Of University Charter

It is of great significance to study the consummation of university regulations on the protection of university students'rights for resolving conflicts and disputes and saving social and judicial resources.Based on the current situation of university charter right guarantee system and university students'cognition of university charter right guarantee,this paper analyzes the problems existing in university charter right guarantee and puts forward corresponding countermeasures,Through analysis and investigation,it is found that there are some problems in the right guarantee system of university articles,such as the vague content of university students'right guarantee,the imbalance between the substantive rights and procedural rights of university students,and the inoperability of the right relief system for university students.There are some problems in college students'cognition of the guarantee of the rights in the articles of association,such as the imbalance between the cognition of the rights in the articles of association and the cognition of the legal rights,the enhancement of the consciousness of the exercise of the rights and the insufficient ability of the exercise of the rights in the articles,the cognition of the relief system and the insufficient ability of the maintenance of the rights in the articles.he reasons for the above problems are reflected in the following four aspects:the superior position of the main body of colleges and universities and the absence of the main body of students;the absence of supervision by the competent department of education administration;the lack of necessary guidance for the sense of rights of college students in colleges and universities;the insufficiency of the rights endowed in the articles of association and the contradiction between the improvement of college students'rights demands.In view of this,we can improve the protection of the rights of college students from five aspects,that is,from the concept level,from "management"to"governance";At the level of organization and technology,strengthen the standardization and maneuverability of university constitution;At the system level,we should broaden the relief channels and innovate the guarantee system.At the level of supervision,we should construct a pluralistic supervision system of university constitution.At the individual level,the college constitution attaches importance to the cultivation of college students'sense of rights.
