| To promote moderate the large scale management of cultivated land moderately through the reform of “three powers separation” is development of Chinese agriculture in the future.The Rural Land Contract Law,as the main content of the revision,will strengthen the protection of management rights of contractual.However,facing different regions,it makes a difference in the implementation of results and the expectation of system when the above-mentioned policy and legal systems is implemented.In the paper,the author attempts to find the land transfer situation of the named Kongpan village as respondents in the southern of Xingjiang in the Last few years in order to analyze the gap in the large scale management for providing more reference for descision-making in the reform.The article is divided into three parts.In the first part,by means of introduction of the basic situation in named Kongpan Village,such as,the appearance of village,and the ratio of land circulation in the transfer mode,it aims to analyze the characteristics and motivation of the arable land circulation.In the second part,the author finds why there are few of disputes an lawsuits in the Kongpan village in which farmers do not sign contracts and file,ever having no intermediary is that both sides can resolve most disputes by themselves without large amount of commercial capital investments and direct interference by state power.In the meantime,village committee also has certain functions.In the third part,the analysis of the obstacles in the implementation of large scale management of cultivated land moderately by author is the in insufficiency of non-agricultural employment and social security due to the fragmented land.Hereafter,according to the obstacles suggestions are proposed that to promote the arable land circulation by increasing non-agriculture employment and improving social security is of theirs own accord for land integration... |
