Exploration Of Promoting The Transfer Rate Of Drug Patents Of Colleges In China

With the rapid development of biology and pharmacy,the innovation and breakthrough of technology.A large number of biology and pharmacy technological achievements are constantly emerging.Colleges in China as one of the main producer of biological and pharmaceutical technology,there are many medical and biological patents emerging every year.According to statistics,from 2007 to 2017,the number of medical and biological patents filed by colleges of China has accounted for about 20% of the total number of medical and biological patent applications of China,and the number is increasing year by year.However,from statistics,the patent transfer rate of medical and biological patents of Colleges in China is generally less than 5%,only the patent transfer rate of medical and biological patents of Jiangnan University,East China University of Science and Technology and South China University of Science and Technology are reach almost 10%.So how to change these technological achievements into productivity and feedback schools and inventors is a big problem to the Universities of China.Compared with the universities of America that on the other side of the ocean,they develop the intellectual property operation earlier than China,So they have developed mature patent transfer model,through statistical analysis,the patent transfer rate of medical and biological patents of Colleges in the United States is much higher than China,generally above 30%.So we will ask: why the transfer rate of medical and biological patents of Colleges in the United States is much higher than China and what can we learn from them? Based on these questions,the paper analyzes the reason of the high patent transfer rate of medical and biological patents of Colleges in the United States from the mature patent transfer policy,flexible transfer model and professional transfer institution.The paper also analyzes the reason of the low patent transfer rate of medical and biological patents of Colleges in China that universities patent transfer system is not mature,lack of internal and professional transfer institutions and patent transfer mode is narrow.At last,the paper get the conclusion that in order to promote the patent transfer rate of medical and biological patents of Colleges in China,On the one hand,we need to learn the successful experience from the United States,including its mature national level patent technology transfer policy,the professional patent technology transfer institution,flexible patent technology transfer mode and practical patent transfer agreement.On the other hand,We should Aim at the problems existing in the transfer of medical and biological patents of Colleges in China,combined with our own actual situation,from the aspect of improving college patent transfer system,strengthening the patent transfer consciousness of researchers in colleges,setting up professional patent transfer institution,equipped with professional patent technology transfer personnel.At the same time,we need to break through the existing patent technology transfer mode continuously,find out more effective and flexible way to transfer the medical and biological patents.In order to avoid blind or unrealistic reform,we should develop the "pilot" work in college patent technology transfer.We will form a set of the most suitable type of medical and biological patents transfer model for our own through the gradual improvement.
