A Study On Investment Legislation Of Basic Pension Fund

With the aging of the population and the increasing aging of our country,how to deal with the increasingly serious old-age problem has become one of the focus of many scholars' attention and research in recent years.The basic pension fund is the "material" foundation of the operation of the basic pension insurance system,and the investment of the basic pension fund is an important means to maintain the long-term operation of the basic pension fund.With the continuous advancement of the rule of law in our country,legislation has become the most efficient means to solve social problems in our country.Although China has also made norms for the investment of basic pension fund through legislation,but due to the short course of history,less experience and other reasons,the current legal norms of the basic pension fund investment in all aspects of the general lack of effective regulation,for the basic pension fund investment buried hidden dangers.This paper mainly uses comparative analysis,empirical analysis and historical analysis,and on the basis of the comprehensive application of law,economics,management and other multidisciplinary knowledge,the relevant problems of the investment legislation of basic pension funds are expounded in four parts.The first part is the theory of the investment of the basic pension fund.This part expounds the concept and current situation of the investment of the basic pension fund and the basic pension fund,and points out the deficiency of the investment of the existing basic pension fund.The second part discusses the current situation and main problems of the investment legislation of china's basic pension fund.This paper analyzes the existing legislative form and the content of the provisions,the investment management mode and the deficiency of supervision,and lays the foundation for the latter.The third part introduces the experience and enlightenment of the investment legislation of the typical national basic pension fund outside the domain.This Department analyzes the relevant legislation of the United States,Japan and Singapore,and provides reference for the improvement of relevant legislation inChina from the aspects of legislative form,terms content,investment management mode and supervision.The fourth part is to put forward the perfect proposal for the investment legislation of china's basic pension fund.By combining extraterritorial experience with the research of domestic and foreign scholars for the second part of the issues raised,from the legislative form,terms content,investment management model and supervision four aspects,respectively,for China's basic pension fund investment legislation to provide feasible recommendations.
