With the deepening of globalization and economic development,knowledge economy,as a new and vigorous economic form,is becoming the increasingly prominent driving force for economic growth.Knowledge economy has become the most basic element among all other elements of value creation.The establishment and perfection of the system has become an important guarantee for the country to give full play to its knowledge resources.China,as a developing country,despite its tremendous achievements,the overall level of science and technology as well as the quality of human resources are still insufficient.This requires the recognition of the importance of protecting intellectual property rights,the consummation of the system of intellectual property rights,the aggrandizement of the capability of independent innovation to realize the development of an innovative as well as knowledge-based economy.As a kind of non-exclusive public goods,knowledge tends to have negative externality in economic activities,and knowledge producers can not cope with the reduction of personal benefits resulting from knowledge spillover,thereby reducing innovation activities.However,the improvement of the intellectual property protection system protects their intellectual assets,the innovators can be rewarded for their innovation.Meanwhile the excessive protection of intellectual property rights will cause innovators to monopolize the market and prevent new knowledge producers from entering the market.Therefore,the measure of the strength of intellectual property protection is necessary for the system.Based on the actual situation in China,this essay aims to provide a theoretical and realistic basis for the improvement of China's intellectual property system by analyzing the inherent impact mechanism of the intellectual property system on China's economic development through empirical analysis.On the basis of the new institutional economics,this essay explores the influence of the intellectual property system on economic development from two aspects of innovation mechanism and international trade.Different from the positive conclusions drawn by the mainstream Western economic schools,this essay attempts to explore the complexity of the impact mechanism of the intellectual property system,including different positive and negative outcomes.This comparatively comprehensive and empirical analysis based on China's actual conditions provides an empirical basis for theoretical analysis.On the impact of the intellectual property system in China's economic development,the main conclusions of this essay are: first,there is a complex mutual influencing mechanism between the establishment of intellectual property system and the development of national economy,including a variety of positive and negative effects,which,according to specific issues,can not be generalized;second,the overall enhancement of China's intellectual property protection level has a positive impact on China's economic development,but its impact on some backward regions and industries is insignificant,and maintaining the weak level of protection is the best strategy so far.
