Research On The Legal Issues Of Social Responsibility Of State-owned Energy Enterprises

The problems arising from the fulfillment of social responsibility by state-owned energy enterprises not only affect the sustainable development of the environment,but also affect the energy security of the country.Therefore,the state must attach importance to the implementation of social responsibility of state-owned energy enterprises.According to a series of problems arising from the practice of fulfilling social responsibility of state-owned energy enterprises,institutional arrangements are made accordingly.This is of great significance for shaping the positive image of the country,ensuring national energy security,improving energy poverty and ensuring sustainable development of the environment.The state has adopted many institutional arrangements to standardize the fulfillment of social responsibility of various enterprises.Although the state has made a lot of efforts on the level of consciousness,legal norms and policy guidance,there are still many problems,including general problems and special problems,in terms of the status quo of legislation and implementation of social responsibility of major state-owned energy enterprises.General problems are common or prominent problems in the process of fulfilling social responsibility of general enterprises.There are some specific problems,such as the legal basis for state-owned energy enterprises to fulfill their social responsibility is too principled,the report of social responsibility of state-owned energy enterprises is too formal,and the content of social responsibility management system of state-owned energy enterprises is missing.Special problems are the problems that the state-owned energy enterprises will encounter in the process of fulfilling their social responsibility.Specifically,the energy universal service obligations are not fulfilled in place,the motive force for fulfilling environmental responsibility is limited,and the legal basis for fulfilling the responsibility for safety in production is absent.The reasons for these problems are complex,involving the low level of effectiveness of legal norms and the special attributes of state-owned energy enterprises.Therefore,it is difficult to solve these problems only by market mechanism or government policy.We must improve the effectiveness of state-owned energy enterprises in fulfilling their social responsibility under the synergy of market mechanism and legal system.This paper tries to solve the problems existing in the process of fulfilling social responsibility of state-owned energy enterprises by improving the legal system and establishing the allocation mechanism.As far as the perfection of the legal system of state-owned energy enterprises’social responsibility is concerned,from the legislative and judicial perspectives,this paper establishes a law system of social responsibility of state-owned energy enterlprises,which is composed of basic laws,departmental regulations and industry regulations,and clearly establishes the energy public interest litigation system at the judicial level.Finally,with the establishment of communication mechanism and management mechanism of social responsibility of state-owned energy enterprises,the path of fulfilling social responsibility of state-owned energy enterprises is improved,which provides a reference path for the state to regulate the fulfillment of general corporate social responsibility and social responsibility of state-owned energy enterprises.
