Research On The Legal Regulation Of Civil Drones In My Country

In recent two years,the civil unmanned aerial vehicles(UAVs)market in China has improved dramatically,and the civil unmanned drones have begun to be used in many fields,from commercial fields such as logistics,film and television shooting industries and some public areas such as disaster prevention and relief,agriculture,forestry,plant protection,police use and so on.Even some people buy civil unmanned drones for entertainment.However,due to the absence of legal regulations in the development of civil unmanned drones,some problems arise.In the first half of 2017,civil unmanned drones in Chongqing,Chengdu,Hangzhou,and other places have occurred some incidents endanger civil aviation safety.These incidents have brought serious impacts.This has led various sectors of the community,especially the law community,to pay attention to the legal regulation of civil unmanned drones.In fact,our country has initially established airworthiness regulations,operational regulations,and air flights in civil aviation laws and regulations.But overall,our country's regulatory system for civil unmanned drones laws and regulations still has the following areas to be improved: the existing civil aviation law system has relatively lagged provisions on civil unmanned drones,and the division of labor for civil unmanned drones supervision is not clear.The lack of systematic airworthiness regulations for civil drones and civil air drone aviation airspace regulation are still unclear.In response to the above issues,the paper proposes to improve the legal system to strengthen the regulation of civil unmanned drones,to establish a systemic civilian drone supervision mechanism,to establish a national standard for civil air drones by regulations,and to refine the law of civil unmanned drones traffic control.The proposal of the system is to regulate the industrial management of drones and promote the healthy development of civil unmanned drones industries.
