Research On The Intellectual Property Protection Of Chinese Overseas Enterprises In The Construction Of "One Belt One Road"

The construction of “the Belt and Road” is a great pioneering undertaking in China's all-round opening to the outside world in the new era.the Belt and Road initiative adheres to the principle of planning together,building together and benefiting together,and strives to create a community of political,economic,and cultural interests,responsibilities,and destiny.Since the implementation of “the Belt and Road” construction,the economic and trade cooperation has achieved remarkable results for five years.China and the countries along “the Belt and Road” country's mutual patent applications have increased substantially.With the gradual deepening of Chinese companies' development of overseas markets,intellectual property disputes are increasing and knowledge is being implemented.Property rights protection strategy is imperative.Strengthening the creation,protection and use of intellectual property is an inevitable requirement for building an innovative country.18 th Congress of the party established an innovation-driven development strategy and clearly put forward the strategic goal of building a strong world of science and technology.19 th Congress of the party also put forward the requirement of "accelerating the construction of an innovative country." Innovation has become the primary driving force for development.In the construction of “the Belt and Road”,it is necessary to cultivate a group of entrepreneurial subjects with core independent intellectual property rights,with high technological content,strong international competitiveness,and the ability to compete internationally in an invincible position.The results of innovation need to be protected by intellectual property rights,and the role of intellectual property rights in promoting the country's economic and social development should be brought into play.Taking the intellectual property environment of the countries along “the Belt and Road” as the starting point,this paper carefully reviews the status of intellectual property rights in ASEAN and some Central Asian countries,systematically analyzes the difficulties faced by overseas companies in China,analyzes the causes of the intellectual property,and addresses the issues.The corresponding strategies for the protection of intellectual property rights of overseas companies were put forward,and specific proposals were put forward from the multilateral,bilateral mechanisms,domestic laws,and enterprise level.The country actively promotes “the Belt and Road” intellectual property cooperation and integration.The domestic legal system for intellectual property is further improved and optimized.Enterprises should establish a core intellectual property system,raise awareness of intellectual property rights,nurture intellectual property culture,and improve the resolution of intellectual property disputes.The ability to accelerate the construction of “the Belt and Road”.
