On The Concept Of Rule Of Law Order

In jurisprudence research,the rule of law is always a meaningful and faraway field.In many propositions formed by the rule of law,rule of law on order is the most fascinating.It is about the state and view of life in the context of order established by the rule of law.It contains the thinking and exploration of people's good life.Therefore,this article hopes to clarify the concept of the rule of law,find the true content that it covers,and try to provide the corresponding guidance for the real life.Firstly,the author analyses some concepts of the rule of law itself,that is,law,rule of law and order.One is about the internal logic of law.The purpose of this part is to find out the direction law by dividing the law in religious sense,the natural law and the law in secular sense.Two is the layout structure of the rule of law,the article makes some explanations about this vocabulary from different dimensions,such as meaning of the word,time,quality,and summed up in the rule of law,what is rule's formal characterization.Three is the logical system of order.Through the comparison of the meaning of the terms in the Chinese and foreign words,the article outlines and describes the order in the ideal mode.Secondly,the paper makes a certain investigation on the relationship between the rule of law on order and its relevant concepts,and tries to highlight the characteristics of the rule of law on order itself.The most closely related ones are the legal order,the order of law and the order of virtue.This paper gives a comparative analysis of their meanings and actual modality,and comprehensively explores the blending and differences of several orders.In addition,the rule of law on order is also related with many other order concepts,such as the rule of men on order,democratic order,autocratic order.This paper also distinguish the implementation method and operation path,different roles of social relations,their value and realistic purport make in every order,further to clear the architecture and context about rule of law on order.Finally,through the discussion of the first two parts,the author tries to conclude the complete connotation about the rule of law on order.It includes its definition,characteristics,value and function.In definition,mainly expound from the operating mechanism,the means,pattern,motivation,goal;In characteristics,describe the symbol about rule of law and order which has been established and features after completion of the order;In value,explain the its unique style;In function,take order into the whole social context and describe its positive effect on the social development and progress.
