Research On The Pre-trial Investigation System Of Community Corrections In Minhang District, Shanghai

It has been 15 years since community correction began in Shanghai in 2003.The implementation of community correction has gradually become a major reform of China's penal system.The implementation of community correction has effectively improved the quality of reforming petty criminals and greatly reduced the cost of supervision.It also reflects the individualization and humanization of punishment in China.As a pre-process of community correction,community correction pre-trial investigation plays an important role in providing an important basis for judicial organs to determine whether criminals are suitable for community correction.It also plays a vital role in sentencing and sentencing.With the continuous development and application of community correction,the pre-trial investigation system is also improving,and a lot of experience has been accumulated.However,as until now,community correction has not been legislated,so community correction pre-trial investigation is still in an awkward situation of lack of institutional guarantee.The corresponding investigation methods,subjects,investigation methods,investigation contents,evaluation criteria and so on have not been clearly unified.This has greatly affected the development and effectiveness of community correction.Therefore,how to accelerate community correction legislation and improve the pre-trial investigation system.It is urgent to establish a unified mode of investigation and evaluation.Based on the author's working experience and field investigation,this paper makes a detailed study on the development status,problems and improvement measures of pre-trial investigation of community correction in Minhang District.The paper also introduces the development of community correction pre-trial investigation abroad,hoping to bring experience and enlightenment to the pre-trial investigation of minhang district.In addition,this paper tries to introduce the concept of big data to improve the scientific nature of pre-trial investigation and evaluation.It is hoped that it can arouse the attention of scholars and judicial work,and further promote the development of community correction pre-trial investigation.
