Summary The debate about justice has never ceased since the formation of human society, moreover, with the development of productivity in modern society, individuals have been freed from the various dependent relationships of the past,In the new mode of life brought by modernization, people's demand for the idea of justice that can meet the current social development is more urgent,But all kinds of justice theory which based on different cultural background, life and moral background has led to a concern that it is inevitable to have disputes when dealing with problems in reality and the argument often built on bias.Sandel criticizes Rawls ‘Theory of distributive justice' and its theoretical basis, pointing out its defects and holding the argument that the premise of constructing a just society lies in citizen's recognition of the idea, which is common good and life.Based on the social development and history since the founding of the United States,Sandel combed the values of Americans in different historical periods and carried out some analysis and explanation, and argued that the American concept of justice itself is constantly swinging between the collective and the individual with the change of social economy and politics.Justice should primarily base on social productivity and be consistent with the moral values and purposes of the good. That is,the principle of justice should base on a direction that above rights and can be guided by the goodness of human perfection and development. On the other hand,Sandel believes that a political system that is good and has the virtues of justice requires a degree of revival of traditional public life, with independent individuals and their trust in the community, society and country which they belong,as well as the common pursuit of public good.In this context,it is necessary to shape the sense of belonging and collective participation of citizens and community,to expand public life to a certain extent,to actively link political rights with the lives of citizens, and to enable citizens themselves to participate actively in the achievement of the goal of justice. The source of the construction of Sandel theory can be traced back to Aristotle, and in his Justice traces of the philosophical thoughts of Hegel and Tocqueville also can be seen,as well as the great philosophers of Arendt.
