The concept of "public rental housing" was first put forward in the government work report in 2009,and has gradually become a part of China's housing security system.In June 2010,seven central ministries and commissions jointly formulated the Guiding Opinions on Accelerating the Development of Public Rental Housing.Due to the persistent high housing prices in China,the existing affordable housing,low-rent housing,price-limited housing and other forms of affordable housing can not fully cover the housing difficult groups in society due to the constraints of their security objects and the existing problems.Under such circumstances,public rental housing has begun to attract more and more attention from the government,and assumes the important responsibility of solving the housing problem of low-income groups in society.In order to better develop the public rental housing system in Beijing,Tianjin,Shanghai and Chongqing,the management measures of public rental housing in line with the actual situation of the city have been formulated respectively.However,China's housing market-oriented situation is becoming more and more serious.In the specific practice of public rental housing,there are some problems,such as unclear definition of ownership,unclear management subjects,imperfect regulatory system and imperfect access and exit system.It is precisely because of the difficulties in practice,therefore,combined with the specific practice of our country,the specific legal problems in the process of developing public rental housing system are analyzed and discussed.Firstly,by analyzing the basic theory of public rental housing,namely the theory of residence right,the theory of social security and the theory of real estate lease contract,the paper accurately defines the difference between public rental housing and other security housing;secondly,taking Tianjin as an example,it compares the actual situation and specific provisions of Beijing,Shanghai,Chongqing and other places.Summarize the legal p.roblems existing in the development of public rental housing in Tianjin;Thirdly,summarize the system and legislation of public rental housing in foreign countries and regions,and make a comparative study with our country,so as to give some inspiration to solve the legal problems of public rental housing system in our country;Finally,according to the practice of our country,choose the right one.The advantages of developing public rental housing system in other countries and regions can be used for reference to better solve the legal problems of public rental housing system in China.
