Due to the continuous expansion of college enrollment in China,only the labor force within the establishment has been unable to meet the development needs of colleges and universities.Under the situation that the number of staff is strictly controlled,it has become a common phenomenon for colleges and universities to employ supernumerary laborers,so supernumerary laborers have become an important part of them.Most of the auxiliary staff,administrative staff and logistics staff of the university enter the university in the form of supernumerary recruitment.They are playing an increasing role in these posts and have become an indispensable part of colleges and universities.Colleges and universities are actively exploring the supernumerary employment mode.At present,the supernumerary employment mode of colleges and universities is relatively diversified and has absorbed a variety of employment modes,including labor contract workers,personnel agency and labor dispatch.The advantage of employing supernumerary laborers in colleges and universities lies in that they can effectively solve the problem of insufficient human resources,flexibly employ workers and reduce the labor cost.But followed,side workers more vulnerable party in colleges and universities as a laborer,the rights and interests security problem is increasingly serious,the rights and interests of its own mainly includes laborer to obtain the labor remuneration rights,the rights and interests of laborer break off,enjoy the rights and interests of the social security,participate in the rights and interests of trade unions in accordance with the law and the rights and interests of vocational training.However,the supernumerary laborers are confronted with such problems as the gap between the economic treatment and the teaching and administrative staff,the lack of institutional guarantee and subjective enthusiasm in the protection of democratic rights and interests,the lack of promotion space,and the embarrassment of social status.If these rights and interests can not be actively and effectively guaranteed,it will seriously hit the working enthusiasm of supernumerary laborers in colleges and universities.Therefore,the state and colleges and universities need to pay more attention to supernumerary laborers,establish sound systems and mechanisms,create a development environment with humanistic care,and improve and enhance the construction of supernumerary laborers.In this paper,through literature research,investigation,analysis,comparative analysis and other methods of university side various rights and interests of the laborer labor model,the existing legal analysis,combining the current situation of college side laborer rights and interests safeguard investigation and analysis,this paper explores the problems of side laborer's rights and interests of colleges and universities,thus further to ensure the side rights and interests of laborers has put forward Suggestions to improve,improve the relevant policies and regulations and internal rules and regulations;By clarifying the principle of equal treatment,implementing a fair compensation system and establishing a compensation compensation mechanism to strengthen and refine the right to equal treatment of the supernumerary workers in colleges and universities;Through the establishment of labor dispatch to the standard labor relations of the transformation mechanism,clear vocational training mechanism to strengthen the college superscriptive workers career security;Strengthen the substantive role of trade unions and give play to their due functions;Supernumerary workers need to improve their awareness of rights protection and psychological quality.It is hoped that the supernumerary laborers in colleges and universities whose rights and interests are damaged can be helped to create a good career development environment.
