In the context of the "Internet+" era,the sharing economy as an emerging industrial model has been applied to all walks of life and has developed rapidly.With the rapid increase of urban population,the rapid development of new technologies and the diversification of public demand,shared bicycles have emerged as a new way of travel.It has the convenience of riding fast and can solve the problem of "last mile"of travel;low carbon travel Environmental protection,in line with people's increasingly environmental protection concepts;ease of traffic pressure,keep up with fast-paced life and other advantages,and thus be popular with the public in a short time.However,it goes without saying that every new thing in the early stage of development will always be hindered by its own inherent defects and market failures,which will lead to a series of problems.Sharing bicycles is no exception.In the convenience of public life,there are also problems that need to be solved,such as low barriers to entry,unhealthy competitive mechanisms,defective deposit management,leaked user information,and uncivilized users.When the administrative regulatory system responds to these emerging issues,it is inevitable that it will be somewhat stretched.At present,the legal regulation of sharing bicycles in China is still in the stage of"wait and see",attempt and exploration.The academic research on shared bicycle is a little less and mostly focuses on the criminal problems and deposit problems caused by shared bicycle.There is a lack of special research on administrative regulation of shared bicycle,and there are fewer authoritative opinions.Practical experience is in a blank,the rapid development of the new economy is far beyond the government's expected scope,the existing administrative regulation of the traditional business model in the face of sharing bicycles,this new thing appears to be unable to cope with a series of social problems caused by it.Therefore,the administrative regulation of shared bicycles can not draw lessons from the theoretical basis and the existing practice,but can only proceed from the actual situation according to the characteristics of the development of the industry,and explore new regulation mode.To regulate the sharing bicycle,we should first have a deep understanding of its background and development characteristics,pay attention to distinguishing the sharing bicycle from the traditional pile bicycle,and also clarify the relationship between the sharing bicycle and the sharing economy.Secondly,on the basis of theory,we should deeply analyze the necessity and rationality of the government's administrative regulation on shared bicycles.We can also get inspiration from the analysis of the government's administrative regulation on the emerging model of online car booking from scratch to provide ideas for the administrative regulation of shared bicycles.Secondly,we should fully analyze the problems that have arisen and may arise in the development of shared bicycle.These problems not only refer to the shortcomings of the bicycle industry itself,but also include the uncivilized problems of users in the process of cycling and the loopholes in government regulation.Only by comprehensively analyzing the problems of all parties in the development of shared bicycle,can we formulate them.To come up with more targeted and effective solutions.Finally,in terms of specific regulation,we should establish a multi-regulation mode of government-led,enterprise collaboration and user participation based on the analysis of the problems and the development characteristics of shared bicycles.On the one hand,cooperative regulation should not be a new concept,and the government is increasingly using cooperation with enterprises and the public to achieve the goal of efficient regulation;on the other hand,the challenge of sharing bicycles to the traditional regulation mode means that the government can not be the only regulator,so it is necessary to call on the sharing bicycle industry to coordinate governance and guide bicycle users to participate actively.
